Y <br /> 062 <br /> (Body Shop) . That list does not include Junk Yards . Section 4 . 3 <br /> of the County Zoning Ordinance. <br /> 3 . The terms "Motor Vehicle Maintenance and Repair" and <br /> "Junk Yard" are both terms defined in the County Zoning Ordinance. <br /> Article 20 of the County Zoning Ordinance . <br /> 4 . The property is located in Bingham Township in Orange <br /> County which township was made subject to the County Zoning <br /> Ordinance on September 2 , 1981. <br /> 5 . The evidence contained in the Record is . that the <br /> commercial activity conducted on the property prior to and on <br /> September 2, 1981 fairly fits within the County Zoning Ordinance <br /> definition of a Junk Yard but does not fit within the County Zoning <br /> Ordinance definition of Motor Vehicle Maintenance and Repair. <br /> Article 20 of the County Zoning Ordinance. <br /> 6 . There is no evidence in the Record of Motor Vehicle <br /> Maintenance and Repair occurring on the property in question prior <br /> to and on September 2, 1981 and there is no evidence in the Record <br /> from which Motor Vehicle Maintenance and Repair on the premises <br /> prior to and on September 2, 1981 can be inferred. <br /> 7 . A decision by this Court reversing the November 2, 1992 <br /> decision of the Board will have the effect of changing the zoning <br /> of the property from EC-5 to AR and RB and making the present use <br /> of the property in violation of the County Zoning Ordinance and <br /> putting the present owner of the property, Wilson, "out of <br /> business . " <br /> Based on the foregoing, the Court, in its discretion, ORDERS, <br /> ADJUDGES AND DECREES as follows: <br /> 3 <br />
