For the purpose of the statute of limitations, and in <br /> recognition of the fact that closeout procedures, <br /> audit, audit resolution and collection of disallowed <br /> costs will occur after the services period, this <br /> Contract shall not be considered completed until final <br /> action on disallowed costs by the USDOL has been taken <br /> and the time for appeal of disallowed costs has <br /> expired. <br /> 4 . COMPENSATION AND METHOD OF PAYMENT: <br /> The WIA Contractor shall be compensated for the work and <br /> services to be performed under this Contract by monthly <br /> reimbursement based on allowable expenditures actually made. <br /> In no event, however, will the total compensation exceed the <br /> sum of $293,892 .00 (refer to specific program allocations on <br /> the cover page) . The LA will advance one-twelfth of the total <br /> contract amount for the purpose of start-up. Provided <br /> further, the WIA Contractor acknowledges that the LA is <br /> receiving monies to fund WIA activities from the State and <br /> that the LA' s obligations to pay any funds is conditioned upon <br /> receipt of such funds. The LA may impose restrictions upon <br /> the maintenance of excess cash by the WIA Contractor <br /> consistent with the restrictions placed upon the LA by the <br /> State and the United States Treasury Department . <br /> Orange County Department of Social Service <br /> WIA Youth Program Allocations <br /> $2931,892 . 00 <br /> 5. WIA Contractor' s Performance Benchmarks: <br /> 1 . The WIA Contractor shall expend at least 100 (100%) <br /> percent of its three month allocation by December 31, <br /> 2014; and <br /> 2 . Shall expend at least sixty percent of its <br /> funding by April 30, 2015; and <br /> 3. Shall expend at least eighty percent of all funding by <br /> June 30, 2015; and <br /> 4. Shall meet the WIA common measures and enrollment <br /> levels as specified in their "Statement of Work". The <br /> LA will review enrollment levels by December 31, 2014 <br /> to ascertain acceptable levels. Acceptable levels shall <br /> be no less than fifty (50) percent of the total number <br /> specified in the WIA Contractor' s "Statement of Work". <br /> Failure to meet this requirement may result in a de- <br /> obligation of funds. <br /> Youth (16-21) Common Measures: <br /> Placement in Employment or Education = 73 . 63 percent. <br /> Attainment of a Degree or Certification = 48 . 10 <br /> percent. <br /> Literacy or Numeracy Gains = 53 . 90 percent <br /> Local Workforce Area Contract Agreement Page 2 of 29 <br /> Amended 7/14 <br />
