4 <br />2006 with the following conditions: <br />1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT <br />standards. <br />2. Homeowners Association documents that provide for maintenance of the Open Space <br />shall be submitted with the preliminary plan. Provisions shall be included in the <br />Homeowners Association documents that would prohibit tree cutting in the Open <br />Space except for maintenance purposes. <br />3. Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L <br />of existing R/W, whichever is greater, along Dimmocks Mill Road on the Preliminary <br />Plan. <br />4. Show five-foot utility easements along both sides of new street rights-of-way. <br />5. Show location of subdivision sign on Preliminary Plan. <br />6. Any proposed lighting shall meet Orange County Lighting Standards. <br />7. A minimum 10-foot wide Open Space Area shall be provided between lots 11 and 12. <br />8. The Developer shall plant in the buffer area along Moorefields Road. <br />The Planning Staff recommended approval, in accordance with the attached Resolution of <br />Approval. <br />Third Action: The Planning Board reviewed the Preliminary Plan on November 7, 2007 and <br />recommended approval in a 5 to 2 vote. <br />Sandra Quinn and Sam Lasris voted against the proposal indicating water and sewer <br />concerns. They felt like the development should be on water and sewer. <br />Two individuals, John Swanson and Wilson Lamb, spoke against the proposal citing <br />concerns with lighting, density issues and.meeting notification. Mr. Swanson and Mr. Lamb <br />had attended the Neighborhood Information meeting (see attached Planning Board Minutes). <br />RECOMMENDATION: The Administration Recommends Approval, in accordance with the <br />attached Resolution of Approval.
