3 <br />Open Space/Buffers: <br />• The open space is provided along the stream corridors and along the road frontages. Its <br />purpose is to help maintain rural character. <br />• 14.95 acres (44.49%) of common area open space is proposed. All of the open space is <br />heavily wooded with hardwood and evergreen, except for the area along Moorefields Road at <br />the southern side of the property where a buffer will have to be created. <br />• ERCD has indicated the proposed plan "appears consistent with the County's desire to <br />minimize adverse environmental impacts with respect to the protection of floodplains, <br />wetlands, natural areas and wildlife habitat." <br />• Homeowners Association will own and maintain open space, buffers, and signage. <br />• A 50-foot Pedestrian Open Space Area (POSA) is provided near the center of the <br />subdivision. <br />• A ten foot wide open space pedestrian access strip is being recommended between lots 11 <br />and 12 consistent with the Planning Board recommendation from its review of the concept <br />plan. <br />Water-Sewer: <br />• Individual wells. <br />• Individual septic systems. <br />Public water and sewer is not available pursuant to Water and Sewer Management, Planning <br />and Boundary Agreement <br />Recreation: <br />• Cheeks District Park <br />No public parkland dedication, is recommended because there are no County recreation <br />and/or open space sites as designated in the Comprehensive Plan on the property. The <br />payment-in-lieu option is recommended (17 lots x $455/lot = $7,735). <br />The Recreation and Parks Advisory Council is recommending payment-in-lieu of publicly <br />dedicated land. <br />Court Decision: <br />• The Owner, Christopher Road Realty, Inc., appealed the Orange County Zoning Officer's <br />determination concerning watershed designations and impervious surface requirements <br />applicable to the property to the Orange County Board of Adjustment on July 19, 2006. <br />• The Orange County Board of Adjustment upheld the Orange County Zoning Officer's <br />interpretation of the Watershed classification and Impervious Surface Requirements. <br />• Christopher Road Reality, Inc, appealed the decision of the Board of Adjustment in Orange <br />County Superior Court on August 21, 2006. <br />• Orange County Superior Court issued a Consent Order on September 20, 2007 in the case <br />of Chistopher Road Realty, Inc. vs. Orange County Board of Adjustment, as explained in <br />more detail in the "Existing Conditions" section above. <br />Development Process, Schedule, and Action <br />Planning Board: <br />• First Action: A Neighborhood Information Meeting was held on November 20, 2006. <br />Individuals in attendance: Applicants, Steve Yuhasz and Kevin Huggins; John <br />Swanson, Steve Rankin, Wilson Lamb, John Cotterman, Chris Lamb, Chris <br />Quinn <br />0 Second Action: The Concept Plan was approved by the Planning Board on December 6,
