Attachment 1 4 <br />The properties in question total approximately one hundred thirty (130) acres in <br />land area, are located within the 1-85/Buckhorn Road Economic Development <br />District, and are located within the Orange County's Comprehensive Plan urban <br />transition land use area. <br />As part of this rezoning request, the Applicant has submitted, in accordance with <br />the provisions of Article Seven (7) and Article Eight (8) of the Orange County <br />Zoning Ordinance, a request to review a proposed Planned Development <br />/Special Use Permit (PD/SUP) application proposing the development of a <br />unified commercial center on the properties. <br />The PD/SUP application proposes the development of over one million square <br />feet of retail, service, office, and limited residential land uses all under unified <br />development control pursuant to the review and approval of the PD/SUP <br />application that proposes a comprehensive master land use, development <br />standards, utilities, multi-modal transportation, and open space program to <br />develop the Buckhorn Village Planned Development. <br />Purpose: To receive citizen comment on the proposed: <br />1. Rezoning request seeking to rezone the properties from: 1-85/Buckhorn <br />Road Economic Development (ED) District to Buckhorn Village Planned <br />Development Economic Development District (BVPD-ED), and <br />2. The submitted PD/SUP application proposing the development of the <br />property as a master planned mixed use commercial site. <br />2. Zoning Ordinance Text Amendments: <br />a. Telecommunications Towers: Session Law 2007-526 made revisions to <br />North Carolina General Statute Chapter 153A--Article 18, part 3B-- Wireless <br />Telecommunications Facilities effective December 1, 2007. To ensure <br />Orange County's wireless telecommunications regulations continue to be <br />consistent with state statutes, the followings sections and sub-sections should <br />be revised. Some of the proposed amendments are derived from revised <br />state statute wording; the others are Center for Municipal Solutions' <br />suggestions. Proposed amendments include: <br />1. Sub-section 6.18 -- Telecommunications Towers and Equipment, <br />2. Sub-section 8.4.1 b) -- Annual Telecommunications Projection Meeting, <br />3. Sub-section 8.8.17a -- Telecommunications Towers, and <br />4. Article 22 -- Definitions. <br />Purpose: To receive citizen comment on proposed telecommunications towers <br />ordinance amendments intended to promote consistency with State Statutes. <br />b.
