1 1~~~ V ~~ S I S <br />1 substantial impact on the County, I think we really need to be sure we are smart about what the <br />2 different phases are, components are, and the risks we run if it's going to stretch over a period <br />3 of time. The other thing is I think we're all challenged by this kind of overlapping situation with <br />4 the rezoning plus the permits and everything on top of it. I understand that if you're asking for <br />5 certain kinds of legislative determinations here, you can't get something that's incredibly so <br />6 specific that if the approval goes in and then somebody else acquires this ????? and really tie <br />7 their hands. l hope you appreciate where we sit that, to the degree that these are very open <br />8 categories and things like that, it's very difficult to figure out our appropriate balance of <br />9 responsibility with regard to specificity and things that need to be nailed down. I just would say <br />10 that I think we are all doing our best to take it very seriously and I know the developers here <br />11 have done sophisticated projects like Meadowmont and so forth, but the more you can work <br />12 with us with this, given that it's a new structure that we don't have a lot of benchmarks about <br />13 ways in which to deal with these overlapping considerations and the phasing, we're all better off. <br />14 I feel troubled by what feels like a somewhat blank check as to something that is really major, <br />15 especially in our economic times. I think that we all need to be very careful in thinking that <br />16 through. I know that you have a very talented team there that's doing a lot with this, but for - <br />T7 ~ example, if it's true that the State is going to be strapped for monayfor various reasons because <br />18 - of the downturn in the economy that we all know is coming, then assumptions about State <br />19 'money for transportation availability, economic incentives, one thing or another, I think those are <br />20 all pretty up in the air kinds of notions. I wish there were a way to deal with this, and l think we <br />21 can,' but I'm just raising the notion, if it were districts a piece at a time,. I would feel better so that <br />22 everything isn't hinged all the way out. <br />23 <br />24 Jay Bryan: Two questions I think, possibly for the attorney about the process. In terms of the <br />25 two issues that are before the Commissioners, the and the SUP application, what materials are <br />26 to be considered by the boards? <br />Z7 . <br />28 Geof Gledhill: All of it. The rezoning is a legislative decision to consider everything that's been <br />29 presented to you in written form, of ali of the statements, just about everything that's <br />30 reasonable. <br />31 <br />32 Jay Bryan: And then with regard to the application itself is there a distinction between what is <br />33 to be considered in terms of what the applicant submits to us. With regard to say, the <br />34 application materials that have been submitted, are those considered the total application that's <br />35 to be approved or not approved? <br />36 <br />37 Geof Gledhill: For the special use permit aspect of this, the application I think is in front of you, <br />38 was introduced to you. Other additional written materials have been offered and put into the <br />39 record. Testimony of witnesses, most of the testimony that I've heard doesn't go the special <br />40 use permit issue, it goes more towards the rezoning issue. But to the degree that the testimony <br />41 is, for example, expert testimony from Mr. Knight concerning property value certainly goes to the <br />42 special use permit. <br />43 <br />44 Jay Bryan: If there's an approval of the application, is that an approval of all of the statements <br />45 that are made in the application, that we approve everything that's in this document regarding alf <br />46 of the proposals. <br />47 <br />48~ Geof Gledhill: I think at the end of the day, what you're going to have in front of you is the <br />49 special use permif that incorporates whatever it is that's in the application materials, whatever it <br />50 is that's been testified to that needs to be there for the special use permit. <br />51 <br />1~. <br />
