12 <br />not entitled to continue a questionable activity pending <br />response to a request for technical assistance. <br />The LA will provide the WIA Contractor with written <br />notification of deficiencies discovered in review of its <br />activities and will endeavor to provide the WIA Contractor <br />with reasonable time to take corrective action regarding the <br />deficiencies, except that reasonable time need not be given <br />where there is a suspicion of criminal conduct or gross <br />misconduct and specific deficiencies need not be identified <br />where the matter has been referred to an investigatory or <br />prosecutorial agency. <br />The failure of the LA to discover or notify the WIA Contractor <br />of deficiencies does not relieve the WIA Contractor of its <br />obligation to meet performance standards, maintain sound <br />administrative and fiscal management, and assure equitable <br />personnel and contractual requirements. The WIA Contractor <br />must identify the contact staff below for the financial and <br />programmatic monitoring requirements: <br />Financial Monitoring Contact: Joyce Lee, Business Officer <br />Name Title <br />Programmatic Monitoring Contact: Sharron Hinton, Human Services <br />Manager Name Title <br />22. COMPLAINTS AND HEARING: <br />The WIA Contractor shall have a complaint and hearing <br />procedure for complaints and grievances by its employees, <br />participants and third parties, including disappointed <br />prospective subcontractors. The procedure may involve <br />investigations by the WIA Contractor and shall result in a <br />written determination by the WIA Contractor. <br />The LA shall have a complaint and hearing procedure for <br />complaints and grievances arising between WIA Contractor and <br />the LA and for appeal of certain complaints and grievances as <br />described in the proceeding paragraph. As to complaints and <br />appeals governed by this paragraph, the LA shall have the <br />authority to investigate and make findings, determinations and <br />orders, including orders imposing corrective conditions and <br />ordering sanctions, after the opportunity for a hearing. <br />Where permitted under this Contract or by law, sanctions or <br />conditions may be imposed prior to an oral hearing in an <br />emergency situation. Orders of the LA may be appealed, where <br />permissible, to the State, the USDOL or to the courts. <br />The complaint and hearings procedures hereunder will comply <br />with the Act and with State law. <br />Local Workforce Area Contract Agreement Page 11 of 29 <br />Amended 7/14 <br />
