l~ <br />Generally speaking, Performance standards, like those in the EDD Design Manual, are by their nature, <br />flexible standards intentionally designed to allow the opportunity for multiple creative solutions and <br />different design scenarios to meet the desired outcomes and objectives of the standard. Unlike ~ C„ <br />prescriptive standards, a performance standard is based on achieving a desired outcome or objective, <br />rather than simply implementing a direct imposition of a rule. To be able to implement, revise, or meet <br />any performance standard, there would need to be a clear understanding of not just what it says, but also <br />it's intended objective. • <br />The applicant has indicated in the text of the project application that due to the "particular nature of this <br />project" that the project, as designed, will not be able to meet many of the required performance and <br />design standards outlined the County's EDD Design Manual. As a result of the applicant's self- <br />assessment ofthe proposed design solution against the existing performance standards for the EDDs, the <br />applicant has determined that in order for this particular project to proceed, as designed, it will require the <br />County to delete or modify 14 of the performance and design standards of the EDD Design Manual. <br />While the applicant has been able to make•this self-determination about the proposed project, so far, the <br />applicant has not shared with the public or the Planning Board that same level of information about the <br />project to be able to demonstrate: <br />® How/whether/why the proposed design would not be able to meet the existing project performance <br />criteria of the Design Manual, <br />® How/whether the requested Waivers and proposed alternative solutions would allow project to <br />better fit the site, <br />How/whether the proposed alternatives to the existing standards would ensure that the objectives <br />of the performance and design standards of the EDD Design Manual were being met. <br />There is currently not enough information provided by the applicant about the layout, form, land use <br />intensity, and designed features of the proposed project design to demonstrate whether or not this project <br />would meet the objectives of the basic performance objectives of the EDD Design Manual. <br />The applicant has said in the text of the project's application that the proposed "development is consistent <br />with the EDD Design Manual", however, the applicant has not provided enough plan information about <br />the `particular nature of the project' or about the existing conditions of the site, to demonstrate whether it <br />would, or would not, be able to meet the performance. and design standards of the EDD .Design Manual. <br />STAFF RESPONSE: By .definition the. project will have to•'comply with all, except the fourteen (14) <br />proposed design solutions, of the standards of the Economic Development Design Manual. Once a formal <br />site plan is submitted proposing the development of this property, the applicant will have to demonstrate <br />compliance with all applicable standards, including those additional standards imposed by the County <br />through the review and approval of the PD application.. <br />We need to make sure that we understand the nature of the request: <br />1. The applicant is requesting that this property be rezoned to a `PD' designation and <br />allow the development of this property as a unified commercial development, <br />2. The applicant has indicated that they will adhere to all applicable `standards' outlined <br />within the Economic Development District Design Manual, with the exception of ~ <br />fourteen (14) standards for which they are proposing `design solutions' for, <br />3. If the County.does not approved a proposed `design solution' then the applicant will be <br />required to adhere to the standards of the Manual, <br />
