Not later than March 31 st of the current fiscal year or at the time of application for new <br /> funds,the Grantee shall account to the Town for the use of the funds appropriated by the <br /> Town by <br /> a. Furnishing a detailed description, quantified to the extent practicable, of the extent <br /> to which the Grantee has performed services for or on behalf of the Town or its <br /> citizens during this fiscal year, and <br /> b. Providing the Town with a copy of Grantee's most recent audit, financial <br /> statement, or other financial information. <br /> For Grantees not requesting new funds a report shall be submitted to the Town <br /> furnishing a detailed description, quantified to the extent practicable, of the extent to <br /> which such grantee has performed services for or on the behalf of the Town or its <br /> citizens during this fiscal year, and providing the Town with a copy of Grantee's most <br /> recent audit, financial statement, or other financial information requested by Town. <br /> In addition,the Grantee agrees to allow the Town to inspect its financial books and <br /> records upon reasonable notice during normal working hours <br /> 4. Grantee shall not discriminate against any employee or applicant for employment because <br /> of age, sex,race, creed, national origin, disability or on the basis of sexual orientation or <br /> gender expression/identity. Grantee shall take affirmative action to ensure that applicants are <br /> employed and that employees are treated fairly and legally during employment with regard to <br /> their age, sex,race, creed, national origin, disability or on the basis of sexual orientation or <br /> gender expression/identity. In the event he Grantee is determined by the final order of an <br /> appropriate agency or court to be in violation of any non-discrimination provision of federal, <br /> state or local law or this provision,this Contract may be canceled,terminated or suspended in <br /> whole or in part by TOWN, and Grantee may be declared ineligible for further TOWN <br /> contracts. <br /> 5. Grantee acknowledges that any appropriations in the budget ordinance to Grantee have been <br /> made on the condition that Grantee execute and comply with all the terms of this agreement. <br /> Grantee further agrees that, if it fails to comply with each and every condition specified in <br /> paragraphs 1 through 4 above, it will repay in full to the Town all sums paid by the Town to <br /> Grantee pursuant to this agreement. <br /> 6. E-VERIFY Requirement. HB786, which became effective September 4, 2013,requires <br /> employers to verify the work authorization of employees through E-Verify in accordance with <br /> NCGS§64-26(a). This law prohibits governmental units from entering into contracts with <br /> agencies who have not complied with E-Verify requirements.. <br />
