The property is within the"critical area" of the Upper Eno River <br /> Protected Watershed,a protected water supply watershed for the Corporation Lake and Lake Ben <br /> Johnson reservoirs. Haley Creek flows westward into East Fork Eno River and soon thereafter to <br /> the Eno River,a source of drinking water for residents of Hillsborough and Orange County. <br /> The land's natural and wildlife habitat and its contribution to the protection of the downstream public <br /> water supply,as well as to the open space and rural character of Cheeks Township,are collectively <br /> referred to as the"conservation values"of the property. <br /> Easement Summary <br /> The purposes of this conservation easement are to a)ensure that the property will be retained forever, <br /> in its predominantly natural,forested,and open space condition;b)to protect native plants and <br /> animals,or plant communities on the property,while allowing certain limited uses on the property <br /> that are compatible with and not destructive of the conservation values of the property;and c)to <br /> prevent any use that will significantly impair or interfere with conservation values of the property. <br /> The Conservation Easement will prohibit any future subdivision of the 3.47-acre Easement Area. <br /> There are currently no structures or improvements within the Easement Area. The Conservation <br /> Easement will allow the construction and maintenance of fences to identify property boundaries, <br /> pedestrian trails(max.6 feet wide;min.30 feet from Haley Creek top of bank),one gazebo(max. 100 <br /> square feet),and two benches—all consistent with Paragraph 2 of the Conservation Easement. <br /> The Conservation Easement will prohibit all commercial timbering of trees. Trees may be removed <br /> only to control insects and disease,to prevent personal injury and property damage, to remove non- <br /> native species,or to salvage wind-thrown timber. Forest management activities must be in <br /> accordance with a Forest Management Plan and agreed to in advance by the Grantee. <br /> All other development rights that are not specified and authorized in the deed of conservation <br /> easement will be extinguished by the Conservation Easement. <br /> List of Attachments(included pti1ji in the full Baseline Documentation Report) <br /> A.
