3 <br />A Resolution requesting the carrbaro Board of Alderman, the chapel <br />Hi i <br />ll Town Council and the Orange County Board Of COmmissioners to <br />alit-harize the Chapel Hill Town Manager to Utilize the Landfill <br />Reserve ftnd - Land Reserve,, to purchase the property known as the <br />Neville tract adjacent to the South Eubanks Landfill,,--. <br />ifRFJMS,, there i!! the need for additional soil for landfill <br />operations at the current landfill site,* and <br />WHEREASO there is a legal right of access for the Neville tract <br />through the Greene tract; and <br />WHEREAS, the purchase of the property known as the Neville tract <br />will provide for the needed soil and remove the access easement <br />across the Greene tract-* ir and <br />!fHEREAS, it is not the intention of the Landf ill hers Group to <br />use the Neville tract as a landfill; and <br />WHEPXAS# if the Neville Tract is used for soil excavation, the <br />Landfill owners Group will be responsible for taking all <br />Practicable neasures to restore the land to a natural state; and <br />WEREM,, cwnarship will be in proportion equal to that of the <br />currOnt landfill (Carrbaro mo 141k, lapel Hill 431k and orange <br />County - 43-%),,L and <br />WHEREAS, it is agreed that the purchase price w±11 be $7,FOOO pex, <br />acre,, with the total to be determined by a survey prior to closing; <br />NOW., THEREFOREP BE IT RESOLVED by the Landfill ownarar Group that <br />the Landfill ownere Group recommends to the qovezm ing boards that <br />they approve resolutions autbarizing the Town of Chapel Hill to <br />Purchase the property known as the Novi lla tract.4 <br />BE IT FU ER R OLVED that tho Landfill Owners Group states its <br />intention to use whatever buff ario nq tAwthniques are practicable to <br />minimize impact on surrounding properties, taking into account the <br />conce-rne of neiqbbcr1%c)od residents In addition to those bufferinq <br />.R, <br />te,JJ1;;;;:,.]1:M3.ques imposed by law. <br />This the 23rd day of rebruary,, <br />
