John Roberts said an identical motion cannot be made again at the same meeting. He offered to verify this. John Roberts said rule 20 of the Board's rules of procedure states that a defeated motion may not be renewed at the same meeting. He said it can be brought back at a second meeting, on the 17tn Commissioner porosin suggested that Commissioner Rich withdraw the substitute motion to allow a vote on the original motion first. Chair Jacobs said there could be discussion about the designation of the Chair at the first committee meeting. Commissioner Rich questioned what will happen if one of the citizens wants to Chair the committee but has no experience. She said someone who is actively involved in meetings and has experience should be the Chair. Commissioner porosin said he puts his confidence in the group that is selected to choose a competent Chair. Commissioner McKee said Orange County is the lead agency and the responsible government unit proposing to set up this group. As such, he feels that the Board should accept the responsibility of having a Commissioner as the Chair. Commissioner Rich withdrew her substitute motion, and Commissioner McKee withdrew his second. VOTE (Original Motion): Ayes, 4 (Chair Jacobs, Commissioner porosin, Commissioner Rich, and Commissioner Price); Nays, 3 (Commissioner Pelissier, Commissioner Gordon, and Commissioner McKee) A motion was made by Commissioner Rich, seconded by Commissioner McKee that one of the two Orange County Commissioners will be the Chair of the newly formed committee. VOTE: Ayes, 5 (Chair Jacobs, Commissioner Rich, Commissioner McKee, Commissioner Price, and Commissioner Gordon); Nays, 2 (Commissioner Price and Commissioner porosin) Donna Baker clarified that these positions will be advertised and will be at-large residents. Chair Jacobs said yes. Michael Talbert asked if the Board wants to see a draft agreement prior to this work group approving an agreement first. He said his understanding is that this group will start with a draft and then come back with something. Commissioner Gordon questioned whether there needs to be some type of agreement with the towns. She said there is a draft that has not been passed, and it clarifies the contract with the towns for urban curbside recycling. Michael Talbert said this is being worked on, and staff is prepared to bring a draft as a starting point for the meeting on the 17th. He asked if this is a starting point that the Board wants to hand to the task force group to work on. Chair Jacobs said his understanding was that the Board wanted the managers to keep going, and if there was a draft proposal, it would be a good starting point to have some agreement to talk about.
