He said staff is now asking the Board to add the Unified Development Ordinance <br /> (UDO) to that codification, as appendix 1. He said this will allow it to be plead and proven in <br /> courts, as the code of ordinances. <br /> John Roberts said the second to last paragraph reads "be it further resolved a recently <br /> adopted amendment to the UDO, ordinance 2014-17, related to kennels, which was adopted in <br /> April of this year, is not included." He said a motion would be needed to include in this <br /> statement the home occupations and agricultural support enterprises text amendments that <br /> were adopted tonight. <br /> Chair Jacobs clarified that the statement should read "be it further resolved a recently <br /> adopted amendment to the UDO, ordinance 2014-17, related to kennels, home occupations <br /> and agricultural support enterprises, adopted in April and May of 2014 are not included in the <br /> unified development ordinance proofs." <br /> Commissioner Rich asked if this will be updated annually. <br /> John Roberts said it is updated as often as staff sends in notifications to Municode, and <br /> this is usually done quarterly. He said Municode updates the website and sends a <br /> republication amendment to the County. He said any text amendment that is adopted will be <br /> effective. He said it will show up on Municode's website as not officially published, but there <br /> will be a link to a PDF version of the document. <br /> Commissioner Rich asked if John Roberts anticipated any confusion from the time that <br /> things are adopted to the quarterly report. <br /> John Roberts does not anticipate any problems from that. <br /> Commissioner Gordon said she wanted to clarify that the kennels, home occupations, <br /> and agricultural support enterprises amendments will not be included. She asked if this has to <br /> be said every time an ordinance is adopted. <br /> John Roberts said the UDO is not part of the code now. He said, since the County is <br /> adding it, it is being added based on the re-publication that was submitted to the County a <br /> month ago, and that did not include these three text amendments. He said, in the future, <br /> whenever a text amendment is passed by the Board, it will automatically be effective, and it will <br /> be put into the code as soon as it is sent to Municode. He said there will be no need for any <br /> extra action in the future. <br /> Chair Jacobs asked if these three items will be incorporated the next time there is an <br /> update. <br /> John Roberts said Municode should be able to add these before the final publication is <br /> completed. <br /> A motion was made by Commissioner porosin, seconded by Commissioner Price to <br /> adopt and authorize the Chair to sign the attached Resolution of Adoption and add the UDO to <br /> the Code of Ordinances of Orange County, North Carolina, with the inclusion of the following <br /> change to the second to last paragraph: "be it further resolved that recently adopted <br /> amendments to the UDO, related to kennels, home occupations and agricultural support <br /> enterprises, adopted in April and May of 2014 are not included in the unified development <br /> ordinance proofs." <br /> .
