If the applicant is a unit of <br />local government, and has not submitted a solid waste management <br />plan that has been approved by the Department pursuant to <br />G.S. 130A- 309.09A(b), the Department may deny a permit for a <br />sanitary landfill or a facility that disposes of solid waste by <br />incineration, unless the Commission has not adopted rules pursuant <br />to G.S. 130A- 309,29 for local solid waste management plans. In any <br />case where the Department denies a permit for a solid waste <br />management facility, it shall state in writing the reason for denial and <br />shall also state its estimate of the changes in the applicant's proposed <br />activities or plans that will be required for the applicant to obtain a <br />permit. <br />d. Management of land clearing debris burned in accordance with 15A <br />NCAC 02D .1903 shall not require a permit pursuant to this section. <br />PART X. EXEMPT PONDS THAT ARE CONSTRUCTED AND USED FOR <br />AGRICULTURAL PURPOSES FROM RIPARIAN BUFFER RULES <br />SECTION 10.(a) Except as required by federal law or in an imminent threat to <br />public health or safety (i) the temporary rules adopted July 22, 1997, January 22, 1998, April <br />22, 1998, and June 22, 1999, and the permanent rule adopted and effective August 1, 2000, as <br />15A NCAC 02B .0233 regarding the protection and maintenance of existing riparian buffers in <br />the Neuse River Basin; (ii) the temporary rule adopted January 1, 2000, and the permanent rule <br />adopted and effective August 1, 2000, as 15A NCAC 02B .0259 regarding the protection and <br />maintenance of existing riparian buffers in the Tar - Pamlico River Basin; (iii) the permanent <br />rule adopted and effective August 11, 2009, Session Law 2009 -216, Session Law 2009 -484, <br />and the permanent rule, as amended, effective September 1, 2011, as 15A NCAC 02B .0267 <br />regarding the protection and maintenance of existing riparian buffers in the Jordan Water <br />Supply Watershed; (iv) the permanent rule adopted effective April 1, 1999, and the permanent <br />rule, as amended, effective June 1, 2010, as 15A NCAC 02B .0250 regarding the protection and <br />maintenance of existing riparian buffers in the Randleman Lake Water Supply Watershed; (v) <br />the temporary rule effective June 30, 2001, and the permanent rule effective August 1, 2004, as <br />15A NCAC 02B .0243 regarding the protection and maintenance of existing riparian buffers in <br />the Catawba River Basin; (vi) the permanent rule adopted and effective February 1, 2009, as <br />15A NCAC 02B .0605 and the permanent rule adopted and effective February 1, 2009, as 15A <br />NCAC 02B .0607 regarding the protection and maintenance of existing riparian buffers in the <br />Goose Creek Watershed (Yadkin Pee -Dee River Basin); (vii) and any similar rule adopted for <br />the protection and maintenance of riparian buffers, collectively referred to as "Riparian Buffer <br />Rules" for the purposes of this section; shall not apply to a pond to which Riparian Buffer <br />Rules would otherwise apply if all of the following conditions are met: <br />(1) The property on which the pond is located is used for agriculture as that term <br />is defined in G.S. 106 - 581.1. <br />(2) Except for the Riparian Buffer Rules and any similar rule adopted for the <br />protection and maintenance of riparian buffers, the use of the property is in <br />compliance with all other water quality and water quantity statutes and rules <br />applicable to the property before the adoption of the Riparian Buffer Rules <br />for the river basin or watershed in which the property is located. <br />Page 8 Senate Bill 112* -Third Edition <br />
