AMEND DEFINITION OF BUILT -UPON AREA <br />SECTION 7.(a) Section 12 of S.L. 2004 -163 reads as rewritten: <br />"SECTION 12. Definitions. — The following definitions apply to this act and its <br />implementation: <br />(5) "Built -upon area" means that portion of a development--project that is <br />covered by impervious , bttt <br />--- - - - - -- - -1 ---- - - -a-� 1 ­ -- - - - - -- --- -- a-° � -- ° - -_ - - -- __ 1 ° __ - -a - - --1 <br />.surface. "Built -upon <br />area" does not include a wooden slatted deck, the water area of a swimming <br />pool, rag vel,or pervious or partially pervious paving material to the extent <br />that the paving material absorbs water or allows water to infiltrate through <br />the paving material. <br />SECTION 7.(b) Section 2 of S.L. 2006 -246 reads as rewritten: <br />"SECTION 2. CLARIFY THOSE UNDERGROUND STORAGE TANKS THAT ARE <br />NOT REQUIRED TO PROVIDE SECONDARY CONTAINMENT UNTIL JANUARY <br />1, 2020 <br />SECTION 8. Section 11.6(a) of S.L. 2011 -394 reads as rewritten: <br />"SECTION 11.6.(a) Notwithstanding 15A NCAC 02N .0304(a)(5) (Implementation <br />Schedule for Performance Standards for New UST Systems and Upgrading Requirements for <br />Existing UST Systems Located in Areas Defined in Rule .0301(d)), all UST systems installed <br />after January 1, 1991,1991, and prior to April 1, 2001, shall not be required to provide <br />secondary containment until January 1, 2020." <br />PART IX. AMEND THE RULES THAT PERTAIN TO OPEN BURNING FOR LAND <br />CLEARING OR RIGHT -OF -WAY MAINTENANCE <br />SECTION 9.(a) 15A NCAC 02D .1903 (Open Burning Without an Air Quality <br />Permit). — Until the effective date of the revised permanent rule that the Commission is <br />required to adopt pursuant to Section 9(c) of this act, the Commission, the Department, and any <br />other political subdivision of the State that implements 15A NCAC 02D .1903 (Open Burning <br />Without an Air Quality Permit) shall implement the rule, as provided in Section 9(b) of this act. <br />SECTION 9.(b) Implementation. — Notwithstanding 15A NCAC 02D <br />.1093(b)(2)(F) (Open Burning Without an Air Quality Permit), open burning for land clearing <br />or right -of -way maintenance is permissible without an air quality permit if materials are not <br />Page 6 Senate Bill 112* -Third Edition <br />
