3 <br /> 1 <br /> 2 — STAFF COMMENT: consistent with other similar projects. <br /> 3 <br /> 4 REQUIRED REVIEW: <br /> 5 Project involves the review of a Class A Special Use Permit in accordance with the provisions <br /> 6 of Section 2.7 of the UDO. <br /> 7 • Held in a quasi-judicial format meaning all parties, for and against the application, <br /> 8 provide sworn testimony as well as competent material and substantial evidence on the <br /> 9 merits of the proposal. <br /> 10 • Applicant has burden of demonstrating project complies with the provisions of the UDO. <br /> 11 • Anyone opposing the application is required to demonstrate through sworn testimony <br /> 12 and competent material and substantial evidence that the project does not comply with <br /> 13 the provisions of the Ordinance. <br /> 14 • Hearsay or unsubstantiated opinions are not sufficient testimony. <br /> 15 • If applicant proves compliance with applicable standards, and there is no evidence in the <br /> 16 record the project does not comply, the permit must be issued. <br /> 17 <br /> 18 REVIEW PROCESS: <br /> 19 • Step One: Review of application at a joint Quarterly Public Hearing by BOCC and <br /> 20 Planning Board. BOCC adjourns the public hearing to a date/time certain to receive the <br /> 21 Planning Board recommendation. <br /> 22 • Step Two: Review of application by Planning Board who makes a recommendation on <br /> 23 the application based on the evidence and testimony offered into evidence during the <br /> 24 public hearing. <br /> 25 — STAFF COMMENT: The Planning Board is currently scheduled to meet and <br /> 26 review this item at their June 4 and July 2, 2014 regular meetings, which <br /> 27 convene at 7:00 p.m. each evening. Meetings are held in the lower level <br /> 28 conference room of the West Campus Office Building at 131 West Margaret <br /> 29 Lane in downtown Hillsborough. <br /> 30 • Step Three: BOCC reconvenes public hearing to receive Planning Board <br /> 31 recommendation. No additional public comment/testimony is accepted. BOCC takes <br /> 32 action on the proposal. <br /> 33 <br /> 34 STAFF INITIAL REVIEW: <br /> 35 • Applicant has submitted documentation required for the review of the project <br /> 36 • Applicant has submitted required documentation for a Class A Special Use Permit (i.e. <br /> 37 required by Section 2.7.3) <br /> 38 • There are goals/objectives/policies within the Comprehensive Plan lending credence to <br /> 39 the viability of the proposal <br /> 40 <br /> 41 RECOMMENDATION: <br /> 42 1. Receive the application, <br /> 43 2. Conduct the Public Hearing and accept public, BOCC, and Planning Board comments. <br /> 44 3. Refer the matter to the Planning Board with a request that a recommendation be <br /> 45 returned to the County Board of Commissioners in time for the September 16, 2014 <br /> 46 BOCC regular meeting. <br /> 47 4.
