20 <br /> 1 WHEREAS, the issues regarding adoption were ultimately resolved and on December 5, 2011 <br /> 2 the general ordinances of Orange County were codified by the Board of County Commissioners <br /> 3 into the Code of Ordinances of Orange County, North Carolina (the "Code"); and <br /> 4 <br /> 5 WHEREAS, due to multiple problems with the complexity of converting the Unified <br /> 6 Development Ordinance ("UDO") to an appropriate format and also several staff changes and <br /> 7 other issues at Municipal Code Corporation, the entity with which Orange County contracted to <br /> 8 maintain the Code, the Code did not include the UDO which was adopted in its unified form on <br /> 9 April 5, 2011; and <br /> 10 <br /> 11 WHEREAS, the Code's adoption ordinance specified that the UDO would remain in effect, <br /> 12 however, and work was continued on adding the UDO to the Code; and <br /> 13 <br /> 14 WHEREAS, on April 3, 2014 Municipal Code Corporation completed the final proofs of the UDO <br /> 15 and delivered them to the County Attorney's office after which both planning staff and the <br /> 16 County Attorney reviewed the proofs and determined the Proofs are ready for codification. <br /> 17 <br /> 18 NOW THEREFORE, BE IT RESOLVED pursuant to North Carolina General Statute §153A-49 <br /> 19 and the Adopting Ordinance of the Code of Ordinances, Orange County, North Carolina, dated <br /> 20 December 5, 2011, the Orange County Unified Development Ordinance, having been originally <br /> 21 adopted on April 5, 2011 and amended from time to time thereafter, and as it is reflected in the <br /> 22 Unified Development Ordinance Proofs dated April 3, 2014 provided by Municipal Code <br /> 23 Corporation, is added to the Code of Ordinances, Orange County, North Carolina, as Appendix <br /> 24 A thereto. <br /> 25 <br /> 26 BE IT FURTHER RESOLVED recently adopted text amendments to the UDO, Ordinance 2014- <br /> 27 017 regarding kennels adopted April 15, 2014, Ordinance 2014-007 regarding home <br /> 28 occupations adopted May 20, 2014, and Ordinance 2014-022 regarding agricultural support <br /> 29 enterprises outside the rural buffer adopted May 20, 2014, are not included in the Unified <br /> 30 Development Ordinance Proofs and will not be published at this time, but shall continue in full <br /> 31 force and effect until and beyond such time as they are officially published in Appendix A of the <br /> 32 Code of Ordinances, Orange County, North Carolina. <br /> 33 <br /> 34 BE IT FURTHER RESOLVED that all future amendments to the UDO shall be approved and <br /> 35 codified in accordance with applicable state law and the Adopting Ordinance of the Code of <br /> 36 Ordinances, Orange County, North Carolina, dated December 5, 2011. <br /> 37 <br /> 38 This, the 20th day of May 2014. <br /> 39 <br /> 40 VOTE: UNANIMOUS <br /> 41 <br /> 42 <br /> 43 b.
