39 <br /> 1 i. Interlocal Agreement for Solid Waste Management <br /> 2 The Board considered referring a draft preliminary Interlocal Agreement for Solid Waste <br /> 3 and Recycling to the recently created Solid Waste Advisory Group (SWAG) with outstanding <br /> 4 issues/provisions to be resolved, with the Agreement subsequently being resubmitted to the <br /> 5 Towns and County for finalization and adoption. <br /> 6 <br /> 7 Michael Talbert reviewed the following background information from the abstract: <br /> 8 <br /> 9 At its May 13, 2014 work session, the BOCC discussed adopting a preliminary Agreement that <br /> 10 would be amended in the future once remaining outstanding issues or areas of potential <br /> 11 disagreement are resolved. The BOCC also discussed that a multi-jurisdictional advisory group <br /> 12 be established to address those outstanding issues and make recommendations to the parties <br /> 13 of the Agreement so that the Agreement can be amended and finalized. At its June 3 meeting <br /> 14 the BOCC formally established the SWAG and indicated that the draft <br /> 15 preliminary Interlocal Agreement (attached) will represent the base document from which their <br /> 16 discussions, revisions and recommendations would be made. A preliminary report from the <br /> 17 SWAG may be presented at the November 20, 2014 Assembly of Governments meeting. The <br /> 18 issues recommended to be addressed by the SWAG with regard to the preliminary Agreement <br /> 19 include, but are not limited to: <br /> 20 <br /> 21 * an interlocal agreement on solid waste; <br /> 22 * reducing solid waste that is not recycled; <br /> 23 * recycling opportunities and services; <br /> 24 * siting a transfer station or landfill within the county; <br /> 25 * supporting public education on solid waste issues; <br /> 26 * construction and demolition waste; <br /> 27 * assuring long-term partnership of the entities involved through an interlocal agreement <br /> 28 on waste handling and disposal; <br /> 29 * addressing equitable funding and mechanisms for establishing fees and making future <br /> 30 joint decisions; <br /> 31 * future use of closed landfill sites; <br /> 32 * investigation of partnership possibilities involving neighboring jurisdictions; <br /> 33 * feasibility of innovative and cost-effective, environmentally-sound methods of disposal <br /> 34 of solid waste beyond burial; <br /> 35 * potential inclusion of biosolids in long-range disposal plans; <br /> 36 * emergency storm debris planning <br /> 37 * treatment of communities impacted by siting of any facilities either within Orange County or <br /> 38 beyond its borders to receive shipments of waste. <br /> 39 <br /> 40 The Towns' and County staffs created a detailed outline from which the draft preliminary <br /> 41 Interlocal Agreement for Solid Waste was produced. Due to time constraints and a need for <br /> 42 elected official level guidance, there are remaining unresolved operational issues and policy <br /> 43 decisions yet to be discussed and will be included in the recommendations from Solid Waste <br /> 44 Advisory Group. The known unresolved operational issues to be addressed by the SWAG are <br /> 45 listed below, but are not limited to: <br /> 46 <br /> 47 • Creation of a permanent advisory committee/group to advise the parties to the <br /> 48 Agreement, including rules of procedure, mission, composition, etc.; <br /> 49 • More thorough definition of outstanding debt as it relates to termination or withdrawal; <br /> 50 • How to bring the University into substantive discussions with regard to becoming a party <br />
