32 <br /> 1 Commissioner Gordon asked what kind of water feature would be used for fire <br /> 2 protection. She referred to page 101 and the emergency services condition. <br /> 3 Michael Neal said at this point the amount of water is not known yet, as the size of the <br /> 4 homes to be built has not been determined yet. He said the amount listed on page 101 in their <br /> 5 packet is the minimum amount of water that would be needed. He said the proposal is to base <br /> 6 the pond size on the largest structure that will be built in the subdivision. He said this will <br /> 7 equate to a certain volume of water necessary to fight a fire for 2 hours. He said the size of the <br /> 8 structure, as well as the materials used in building will determine the amount of water. He said <br /> 9 once there are builders lined up and the details of the structures are determined, the pond will <br /> 10 be built to accommodate. . <br /> 11 Commissioner Gordon asked how the maximum building size can be determined before <br /> 12 the houses are built. She does not see how you can restrict the size of the houses. <br /> 13 Michael Neal said the septic fields will determine the maximum size house that can be <br /> 14 built. He said once the builder or builders are selected there will be more information available. <br /> 15 He said there is also an option to build the largest size pond necessary to be in compliance. <br /> 16 Commissioner Gordon referred to page 15, Article 3, regarding membership and voting <br /> 17 rights. She asked for clarification on the 2 classes of voting membership. <br /> 18 Pat Mellot said these are the articles of membership for the proposed HOA. He said this <br /> 19 is a standard provision. <br /> 20 Commissioner Gordon asked why it was in the packet. <br /> 21 Michael Harvey said the ordinance requires the auxiliary document be presented and <br /> 22 provided. <br /> 23 John Roberts said the HOA document is there only for the Board to review, and it does <br /> 24 not require any action. <br /> 25 Commissioner McKee referred to the water requirement. He said there is an automatic <br /> 26 three department response to all structure fires. He said these responding departments, with <br /> 27 the exception of Chapel Hill, run tankers. He said there is water transport available in addition <br /> 28 to the pond on site. <br /> 29 Commissioner Rich asked if any of the homes would be part of an affordable housing <br /> 30 plan. <br /> 31 Michael Harvey said this property is in the water supply watershed and is not allowed to <br /> 32 participate in the density credit system. <br /> 33 Michael Harvey said Michael Neal proposed a pond for the worst case scenario, and this <br /> 34 may be reduced once the size of the homes being built is determined. He said the fire marshal <br /> 35 will continue to work with the neighborhood to make sure the conditions are met. <br /> 36 Commissioner Dorosin asked for clarification on the location of the 3 lots in the Orange <br /> 37 County school district. <br /> 38 Michael Harvey designated this on the map. <br /> 39 Chair Jacobs asked if there had been any communication from either of the school <br /> 40 districts. <br /> 41 Michael Harvey said both school districts have stated that issuing caps would not be a <br /> 42 problem at the appropriate time. He said the applicant has to make formal petitions to both <br /> 43 school districts to see if the transfer will be allowed. <br /> 44 Chair Jacobs said both school systems have to be involved. He noted that there are <br /> 45 issues with capacity. <br /> 46 Michael Harvey said Chapel Hill will need to decide if they want to assume responsibility <br /> 47 for three additional lots. <br /> 48 Commissioner Gordon said it was stated in the materials that staff feels it is unlikely that <br /> 49 CHCCS would accept the 3 additional lots. <br />
