30 1 Commissioner Rich moved a substitute motion, seconded by Commissioner McKee to 2 include everything in the original motion, with a designation that that member of the Board of 3 County Commissioners should be the Chair of this committee. 4 5 Commissioner Dorosin asked John Roberts, if the substitute motion fails and then the 6 original motion fails, whether either motion can be raised again. 7 John Roberts said an identical motion cannot be made again at the same meeting. He 8 offered to verify this. 9 John Roberts said rule 20 of the Board's rules of procedure states that a defeated 10 motion may not be renewed at the same meeting. He said it can be brought back at a second 11 meeting, on the 17th 12 13 Commissioner Dorosin suggested that Commissioner Rich withdraw the substitute 14 motion to allow a vote on the original motion first. 15 Chair Jacobs said there could be discussion about the designation of the Chair at the 16 first committee meeting. 17 Commissioner Rich questioned what will happen if one of the citizens wants to Chair the 18 committee but has no experience. She said someone who is actively involved in meetings and 19 has experience should be the Chair. 20 Commissioner Dorosin said he puts his confidence in the group that is selected to 21 choose a competent Chair. 22 Commissioner McKee said Orange County is the lead agency and the responsible 23 government unit proposing to set up this group. As such, he feels that the Board should accept 24 the responsibility of having a Commissioner as the Chair. 25 Commissioner Rich withdrew her substitute motion, and Commissioner McKee withdrew 26 his second. 27 28 VOTE (Original Motion): Ayes, 4 (Chair Jacobs, Commissioner Dorosin, Commissioner 29 Rich, and Commissioner Price); Nays, 3 (Commissioner Pelissier, Commissioner Gordon, and 30 Commissioner McKee) 31 32 A motion was made by Commissioner Rich, seconded by Commissioner McKee that 33 one of the two Orange County Commissioners will be the Chair of the newly formed committee. 34 35 VOTE: Ayes, 5 (Chair Jacobs, Commissioner Rich, Commissioner McKee, 36 Commissioner Price, and Commissioner Gordon); Nays, 2 (Commissioner Price and 37 Commissioner Dorosin) 38 39 Donna Baker clarified that these positions will be advertised and will be at-large 40 residents. 41 Chair Jacobs said yes. 42 43 Michael Talbert asked if the Board wants to see a draft agreement prior to this work 44 group approving an agreement first. He said his understanding is that this group will start with 45 a draft and then come back with something. 46 Commissioner Gordon questioned whether there needs to be some type of agreement 47 with the towns. She said there is a draft that has not been passed, and it clarifies the contract 48 with the towns for urban curbside recycling.
