Perhaps "Acceptance of Planning Board <br />Recommendation and Decision on Land Use and Planning - Related Matters," or <br />similar phrasing, may be appropriate. Since the public hearing process may be <br />changing and "real' planning - related public hearing items (e.g., oral comments <br />accepted) might be listed on the BOCC agenda, it may be even more desirable to <br />add an additional Section to the BOCC agenda to better differentiate oral public <br />hearings from items that are on the agenda to close the public hearing and take <br />action. <br />Staff has written a document outlining various options for closure of the public <br />hearing. Staff surveyed other jurisdictions in North Carolina to help determine <br />various options for handling the public hearing process. The document is included at <br />the end of this Form. <br />Public Hearings for Legislative vs. Quasi - Judicial Items <br />The UDO currently makes no distinction between public hearings for legislative items <br />(e.g., rezonings /map amendments and text amendments) and quasi - judicial (e.g., <br />special use permits) items. Because of the nature of quasi - judicial items, public <br />hearings for special use permits can be lengthy. Although the proposed text <br />amendments have been written without distinction between legislative and quasi - <br />judicial matters, it would be possible to change the proposed language to limit quasi - <br />judicial matters to few agendas per year while expanding the number of times per <br />year planning - related legislative items could be considered. <br />• Comprehensive Plan Linkage (i.e. Principles, Goals and Objectives) <br />Land Use Goal 6: A land use planning process that is transparent, fair, open, <br />efficient, and responsive. <br />New Statutes and Rules <br />N/A <br />C.
