The preferred realignment of Baldwin <br /> Road was to connect it with Lawrence Road, as shown <br /> generally on the Hillsborough Thoroughfare Plan. <br /> However, the connection of the rights-of-way for the <br /> two roads depended on whether right-of-way could be <br /> obtained to realign Lawrence Road. <br /> Planning Board Recommendation <br /> The Planning Board unanimously recommended approval of <br /> the Preliminary Plan for Black Walnut Farm, using the <br /> existing Baldwin Road. <br /> In a separate motion, the Planning Board unanimously <br /> recommended that Planning Staff work with NCDOT in <br /> obtaining approval to move Baldwin Road farther to the <br /> east, away from the Baldwin property and that the Board <br /> of Commissioners attempt, in all ways, to move up in <br /> priority, the paving of Baldwin Road. <br /> Board of Commissioners - January 17, 1995 <br /> The Board of Commissioners considered the subdivision <br /> on January 17, 1995. A sketch of two possible <br /> alignments of Baldwin Road was presented by the Staff. <br /> One alignment would shift Baldwin Road somewhat to the <br /> east, allowing the right-of-way to be located on the <br /> applicant's property. The other alignment would shift <br /> Baldwin Road even farther to the east, where it could <br /> eventually be connected with Lawrence Road. The latter <br /> alignment was indicated as the most desirable, but <br /> would involve dedication of right-of-way for Lawrence <br /> Road, on the south side of St. Mary's Road, which is <br /> beyond the control of the applicant. The alignment <br /> along the western property line of the property of the <br /> applicant would be preferable to the existing location <br /> of Baldwin Road, and could be accomplished by the <br /> applicant. It was recommended that the right-of-way <br /> along the western boundary be dedicated and the road <br /> constructed in this location. The applicant, however, <br /> took the position that he should be able to use the <br /> existing Baldwin Road because it is a public road, and <br /> was opposed to any requirement to dedicate a new right- <br /> of-way or pave Baldwin Road. However, the applicant <br /> offered, at the Planning Board meetings, to realign <br /> Baldwin Road onto his property, and to construct it to <br /> NCDOT paved road standards, provided he could do so <br /> through the property owner participation paving program <br /> with NCDOT. The Board of Commissioners tabled action <br /> on the subdivision and directed Staff to provided <br /> additional information regarding the issue of Baldwin <br /> Road. <br />
