51 <br /> the subdivision accessing St. Mary' s Road. The <br /> Planning Board' s recommendation was that the <br /> applicant move that access to Baldwin Road and <br /> the applicant did that. It is and has been the <br /> desire of the developer to pave Baldwin Road. <br /> Discussions are underway with NCDOT regarding <br /> participatory paving for that portion of Baldwin <br /> Road. There is a letter of interest on the part <br /> of NCDOT; however, work is still in progress with <br /> them to determine whether or not that can be <br /> done. It is in the interest of the developer for <br /> Baldwin Road to be paved. If there is any way <br /> that can be worked out with NCDOT, that will be <br /> done. It does depend on cooperation with NCDOT <br /> and that cannot be guaranteed by the developer. <br /> Since cooperation from NCDOT cannot be guaranteed <br /> by the developer, Mr. Yuhasz stated that he would <br /> not like to see a condition that Baldwin Road be <br /> paved. However, he noted that he would be <br /> agreeable to the following: "If Baldwin Road is <br /> paved through a participatory situation with the <br /> State, the right-of-way of Baldwin Road would be <br /> no closer to the Baldwin property line than shown <br /> on the drawing. " He felt that was as far as the <br /> developer could commit himself until commitment <br /> from NCDOT. <br /> Howie asked if the proposed paving of 200 feet <br /> past the entrance to the development is the same <br /> as presented at the last Planning Board meeting. <br /> Yuhasz responded yes; it is simply a question of <br /> working out details with NCDOT regarding the <br /> participatory agreement with the Roberts. <br /> Baldwin asked if the 200 feet of Baldwin Road <br /> would be paved regardless of what action is taken <br /> by NCDOT. Yuhasz responded that it is dependent <br /> on NCDOT. However, every indication at this point <br /> in time is that there will be agreement between <br /> NCDOT and the developer for the paving. Mr. <br /> Yuhasz reminded the Board that the paving was not <br /> suggested by the Planning Board but proposed by <br /> the developer because he felt it would be to the <br /> advantage of the subdivision and all properties <br /> on Baldwin Road. He emphasized again that such a <br /> condition might be impossible to meet and felt <br /> such a condition should not be imposed since it <br /> depends upon cooperation of NCDOT. <br /> Waddell stated that he would like the developer <br /> to hold to any promises made to the Planning <br /> Board. He noted that he did understand the <br /> developer' s wish to be clear regarding <br /> participatory paving. Mr. Yuhasz stated that the <br />
