Collins, Jr., Planning Director <br /> Orange County Planning Department <br /> 306F Revere Road <br /> Hillsborough, NC 27278 <br /> Re: Courtesy Review of Watershed <br /> Zoning Regulations/ JPA <br /> Dear Marvin: <br /> Thank you for providing me with the opportunity to comment on the proposed <br /> amendments to Orange County's development regulations as they apply to the Joint Planning <br /> Area. I offer the following comments for your consideration: <br /> 1. Article 6.23 -the approval of this amendment should not have any negative <br /> impact on the University Lake Watershed since no additional dwelling units may <br /> be constructed and this amendment may well reduce roadway construction by <br /> providing more design flexibility. <br /> 2. Article 4.1 - This amendment seems reasonable due to the relatively small size of <br /> the fiber optic equipment(3.5' X 7'). <br /> 3. Article 6.23: <br /> a. Wells, if permitted within the stream buffer, should require mitigation of <br /> the disturbed area. <br /> b. This amendment doesn't propose any changes to the 300' or buffer <br /> setback requirement for University Lake; however it would apply to the <br /> Cane Creek and Lake Orange reservoirs by allowing the septic tank, <br /> pumps, and etc. to be located within 150' of the reservoir. I understand <br /> that this amendment is needed to address a problem associated primarily <br /> with Lake Orange and would be of limited use for Cane Creek; therefore I <br /> suggest that this amendment be structured to exclude Cane Creek(CANE- <br /> CA) and only be applicable to Lake Orange (U-ENO-CA). <br /> c.& d. These provisions basically allow the continuation of a nonconforming <br /> situation as conforming which may, for most situations, be acceptable; <br /> however, the noconforming use provisions should still apply, particularly <br /> for uses such as the asphalt plant. <br /> e.
