1. The project is proposed to be under unified control and to be' planned and developed as a /
whole;
Staff Comment: This requirement is outlined within Section 7.2 (a) of the Ordinance
2. The development is proposed to be developed as a single development, including the
installation of all necessary infrastructure, for all of the property referenced for the project;
Staff Comment: This requirement is outlined within Section 7.2 (b) of the Ordinance
3. The application indicates that the provision, operation and maintenance of landscaped and
open space areas, parking facilities, individual buildings, and street/sidewallc improvements
will be for common use by the occupants of the district and will not be maintained at general
public expense;
Staff Comrne~zt: This requirement is outlined within Section 7.2 (e) of the Ordinance
4. The proposed use of property is required to be reviewed and .approved as a Planned
Development in accordance with Section 2.2 Table of Permitted Uses of the Orange County
Economic Development District Design Manual; and
5. The applicant has requested to deviate from specific provisions of the Orange County
Economic Development District Design Manual, specifically proposing fourteen (14) design
solutions that replace existing regulatory standards.
Staff Comme~zt: This requirement is detailed within Section 7.21.1 PD-ED District:
Definition and Intent of the Ordinance.
Ultimately, this project is a Planned Development due to:
1. The applicant's desire to deviate from fourteen (14) of the individual design standards
established within the Economic Development Design Manual.
As a result a Planned Development application is required per Section 7.21.1 of the
Ordinance,
2. The Table of Permitted Uses of the Economic Development Design Manual defines the
proposed use as a Planned Development project, specifically: `Retail trade, sales and rental
of durable- and convenience goods, merchandise, and equipment, including mail order
houses, in a separate, free-standing building'.
As we have multiple, independent, principal land uses in multiple structures, rather than ali uses
located within an enclosed single building (i.e. a mall) this request has to be processed as a
SUP, and
3. The proposed development would be under unified control with common use and
maintenance responsibility for all parking areas, internal streets and pedestrian paths, and
buffer/open space.

14
