1 <br /> unable to agree on entitlement to or on the amount or extent, if any, of any adjustment in the <br /> Contract Price or Contract Times, or both, as a result of any delay in Owner's furnishing the Site <br /> or a part thereof, Contractor may make a Claim therefore as provided in Paragraph 10.05. <br /> B. In the event the Project involves private land, upon reasonable written request, Owner shall <br /> firr-nish Contractor with a current statement of record legal title and legal description of the lands <br /> upon which the Work is to be performed and Owner's interest therein as necessary for giving <br /> notice of or filing a mechanic's or construction lien against such lands in accordance with <br /> applicable Laws and Regulations. <br /> C. Contractor shall provide for all additional lands and access thereto that may be required for <br /> temporary construction facilities or storage of materials and equipment. <br /> 4.02 Subsurface and Physical Conditions <br /> A. Reports and Drawings: The Contract Documents identify: <br /> 1. If during the preparation of these Contract Documents, subsurface or geotechnical <br /> explorations were conducted which are relevant in the discretion of the Engineer to the scope <br /> of the work, the findings of such will be included in the Appendix of the Specifications. The <br /> Contractor shall be responsible for obtaining such reports and explorations it deems <br /> necessary and advisable for the performing of the Work in accordance with the Contract <br /> Documents. <br /> 2. Information and data reflected in the Contract Documents with respect to existing structures <br /> and facilities at or contiguous to the Site are based upon information obtained from varying <br /> sources which may include reports, drawings or other data of those facilities presently on file <br /> with the Owner. The Owner and Engineer do not guarantee the accuracy of any such <br /> information. The Contractor shall be responsible for field verifying all conditions and <br /> measurements and for determining the suitability of the site for the proposed Work. <br /> B. Limited Reliance by Contractor on Technical Data Authorized: any reports and drawings which <br /> have been identified in Article 4.02 A I are not Contract Documents. However, in the event the <br /> Engineer specifically calls out and designates certain information in such reports and drawings as <br /> "Technical Data" than Contractor shall have a limited right to rely upon the accuracy of the <br /> designated Technical Data. Other than the designated Technical Data, any information provided <br /> and depicted on the Drawings is merely intended to be a general representation of the physical <br /> conditions likely be encountered during the Work and shall not constitute a guarantee or <br /> warranty by the Engineer or Owner that actual conditions will not vary from that which is <br /> depicted. Except for the Contractor's right to rely on the designated technical data, which is <br /> limited as more specifically shown below,_Contractor may not rely upon or make any claim <br /> against Owner or Engineer, or any of their officers, directors, members, partners, employees, <br /> agents,consultants,or subcontractors with respect to: <br /> 1. the completeness of such reports and drawings for Contractor's purposes, including, but <br /> not limited to, any aspects of the means, methods, techniques, sequences, and procedures <br /> of construction to be employed by Contractor, and safety precautions and programs <br /> incident thereto; or <br /> EJCDC C-700 Modified Standard General Conditions of the Construction Contract <br /> Copyright(D 2007 National Society of Professional Engineers for EJCDC.
