warranties during the one-year period following the date of Substantial Completion <br /> established by Paragraph 14.04. Contractor includes in this warranty materials and <br /> equipment specified by Engineer by brand name. The warranty provided in this Paragraph <br /> ' 6.03 shall be in addition to and not in limitation of any other warranty required by the <br /> Contract Documents or otherwise prescribed by law and shall be in addition to all other <br /> rights and remedies available to Owner. All warranty obligations are cumulative to and in <br /> addition to all remedies available to Owner pursuant to the Contract Documents and <br /> applicable law. <br /> ' C. All materials and equipment shall be stored, applied, installed, connected, erected, protected, <br /> used, cleaned, and conditioned in accordance with instructions of the applicable Supplier, except <br /> as otherwise may be provided in the Contract Documents. <br /> ' D. Materials and equipment stored off site shall be stored in a bonded, secure warehouse. Any <br /> such materials and equipment stored off site shall be available for review by Engineer's <br /> ' representative. Material and equipment shall be stored and maintained while in storage in a <br /> manner consistent with the manufacturer's recommendations. Such maintenance during storage, <br /> or prior to startup shall be documented and presented to the Engineer. Risk of loss of stored <br /> materials and equipment shall be on Contractor, whether titled in the name of the Contractor or <br /> whether title previously passed to the Owner as a result of payment for the stored materials and <br /> equipment. <br /> ' E. The Contractor shall have responsibility for the care of all equipment and materials, including <br /> those furnished by the Owner, if any, and shall bear the risk of injury, loss, or damage to any part <br /> thereof by action of the elements or from any other cause, until final completion. Contractor <br /> shall rebuild, repair, restore, and make good all injuries, losses, or damages to any portion of the <br /> Work or the equipment or materials occasioned by any cause before completion and acceptance <br /> of the Work and shall bear the expense therefore. Contractor shall, at no additional cost to <br /> Owner,provide temporary measures and suitable structures as they might be necessary to protect <br /> the Work or any portion thereof from damage. <br /> ' F. Suspension of the Work or the granting of an extension of time for any cause whatever shall not <br /> relieve Contractor of his responsibilities for the Work as specified herein including the <br /> continuing care and maintenance of stored materials and equipment as well as work <br /> accomplished to date. <br /> G. If the equipment furnished by the Contractor differs in dimension, orientation, horsepower <br /> requirements, pipe connection sizes, or is otherwise non-conforming to the Contract Documents, <br /> the Contractor shall be responsible for the furnishing of all properly-sized connecting piping, <br /> motor starters,motor controls, and electrical wiring and connections, and all other work required <br /> to properly install the equipment in complete operating condition. Further, such non- <br /> conforming equipment or materials shall be submitted as a "Substitute" in accordance with <br /> ' Section 6.05 of the Modified General Conditions, including and subject to Paragraph 6.05. E. <br /> Engineer's Cost Reimbursement.
