' Resident Superintendent without written approval from the Engineer. However, the approval of <br /> any supervisor by the Engineer shall not relieve the Contractor of its obligation to properly <br /> supervise and perform the Work. <br /> B. If at any point during the progress of the Work the Owner determines, in its sole discretion, that <br /> the Resident Superintendent is inadequately performing its services, the Owner may direct in <br /> writing the Contractor to replace the Resident Superintendent within thirty (30) days of such <br /> notification. The resumes of any proposed new Resident Superintendent shall be submitted to <br /> the Engineer for approval prior to their commencement of work on the project. <br /> ' 1. The Resident Superintendent shall provide Owner and Engineer with a written daily field <br /> report containing, as a minimum,the following information: <br /> a. the number of personnel on site, identified by craft or trade, employer and work activity, <br /> and the number of hours worked during the workday; <br /> ' b. the types and numbers of equipment on site and the time each piece of equipment was <br /> used or stood idle during the workday; <br /> c. any materials or equipment received on site during the workday; and <br /> ' d. the identification and quantity of any unit price work, if any,installed during the day. <br /> Said daily field reports shall be submitted to Owner and Engineer not less than weekly. <br /> ' C. For purposes of giving or receiving notices, directives, Change Orders, or any other information <br /> from Owner or Engineer to Contractor, Contractor shall designate a specific individual as Project <br /> Manager to receive such notices, directives, Change Orders, or other information. If the person <br /> so designated by Contractor is not available, Contractor shall (in writing addressed to Owner and <br /> Engineer)identify the individual who is acting as his authorized representative. <br /> D. Contractor acknowledges that its obligation to complete the Work in accordance with the <br /> Contract Documents shall not be affected or amended as a result of any act by Engineer or any <br /> other Owner's consultant, or as a consequence of any field inspections or observations or <br /> approval of any Application for Payment, or in regard to any other duty performed by Engineer <br /> or other Owner's consultant for the benefit of Owner,unless Owner and Engineer shall expressly <br /> approve Contractor's action in advance in writing specifically identifying the action approved. <br /> ' Furthermore, Contractor shall not be relieved of any responsibility to complete the Work in <br /> conformity with the contract Documents as a consequence of any knowledge of non-conformity <br /> obtained by an Owner's representative, including Engineer, whether or not such representative <br /> ' acts or fails to act on such knowledge.
