ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: August 22, 2006 <br />SUBJECT: Authorization to Close <br />DEPARTMENT: Purchasing and Central <br />Services <br />Action Agenda <br />Item No. ,5-p <br />on Eubanks Road <br />PUBLIC HEARING: (YIN) No <br />County Attorney <br />ATTACHMENT(S): <br />INFORMATION CONTACT: <br />Pam Jones, 245-2652 <br />Geof Gledhill, 732-2196 <br />PURPOSE: To consider authorizing the County Attorney tc complete closing on the Eubanks <br />Road property, acquired for siting the Animal Services Facility., <br />BBACKGROUND: In September 2005, the Board authorized the purchase of a 5.5 acre parcel <br />of land on Eubanks Road as a potential site for the proposed Animal Services Facility for a total <br />of $167,000. One of the conditions of closing was that the County acquire the needed <br />regulatory approvals from the Town of Chapel Hill. The County has received reasonable <br />assurance through various conversations with Town Planning staff that the property may be <br />used for the intended purpose, although a Special Use Permit (SUP) and perhaps re-zoning <br />may be required. Since the process is lengthy (12 months is cited as the timeline for expedited <br />review), the County Attorney and Staff are recommending that the Board authorize the property <br />closing in advance of the requirement far regulatory approval condition being met, <br />In the unlikely event that an SUP or re-zoning request is not granted, the property is desirable <br />for and would likely be used as buffer area for the Landfill, which is immediately to the west of <br />the subject property. <br />FINANCIAL IMPACT: There is na additional financial impact prompted by this action. Funding <br />far the purchase of this property is provided by the 2004 2/3 Net Debt Reduction Bonds, as <br />approved by the Board in September 2005. <br />RECOMMENDATION(S): The Manager recommends that the Board amend the Offer to <br />Purchase and Contract to delete the requirement that the Town of Chapel Hill approve Orange <br />County s planned governmental use of the property before the County is required by the <br />contract to purchase the property; and authorize the County Attorney and the Finance Director <br />to close on the purchase of this property as soon as practical. <br />
