57 <br />in the Lease, which date may be selected by Tenant in its sole discretion, but in no event later <br />than the expiration of the Approval Period. The Term of the Lease shall expire on its fifteenth <br />anniversary (the "Expiration Date "), except as extended as provided below. <br />2. RENEWAL TERMS. Tenant has the right to renew the Lease for three (3) additional <br />periods of five (5) years (the "Renewal Terms) ") from the expiration of the original Term of the <br />Lease or the then current Renewal Tenn. In the event that Tenant elects not to exercise any or all <br />of the Renewal Terms, Tenant shall have the right to continue the Lease for a period of between <br />one (1) and twelve (12) months after the end of the then - current Term (also a "Renewal Term "). <br />3. LEASED PREMISES. The Premises is described in Exhibit "1 ". The Premises is leased <br />together with, and includes all of Landlord's air rights, water rights and any easements, rights -of- <br />way or other interests appurtenant to the Property, including in, on, under or to any land, <br />highway, alley, street or right -of -way abutting or adjoining the Property, as necessary for <br />Tenants "Intended Use ". <br />4. TENANT'S EXCLUSIVE USE. During the 'Perm of the Lease and any Renewal <br />Term(s), Landlord covenants that it will not (a) use or lease or (b) permit any tenant to use or <br />lease or (c) permit any occupant or subtenant or assignee of a tenant or occupant to use any of <br />the Property outside of the Premises, or any other property located within a radius of one (1) mile <br />of the Property in which Landlord has an interest, for the purpose of conducting a business that is <br />engaged in the solar power generation business and/or a use similar to the Intended Use. <br />5. RIGHT OF FIRST REFUSAL. During the Term of the Lease and any Renewal Term(s) <br />thereto, Tenant shall have a right of first refusal, as detailed in the Lease, with respect to sales or <br />leases of the Property or the Premises. <br />6. COUNTERPARTS.
