Article 5. Uses 21 <br />Section 5 1 Establishment of Use Requlations <br />(C) In addition to the listing of such uses, the Board of County Commissioners intends tha <br />the general standards and the more specific requirements established herein/he shall <br />used by the Board of Adjustment, the Planninnd the Board of County <br />Commissioners, as appropriate, to direct delibupon application or the proval of <br />ecial Uses <br />(D) It is a express intent of the Board of County ioners to define e the areas of <br />concer onnected with each Special Use and de standards which applications <br />for such S cial Use shall be evaluated <br />(E) Establishmen f Classes of Special Uses, y To prove or Disapprove <br />There are hereby e ablished the following clap tal Uses which shall be approved or disappro as shown <br />(1) Class A - Approve r disapproved by f County Commissioners (2) Class B - Approved or i approved by f Adjustment <br />5 1 4 Conditional Uses <br />(A) The Board of County Commissioner 's mi ful of its responsibility to protect the public <br />health, safety and general welfare f the rest nts of Orange County and intends to <br />encourage development within e County consi ent with that purpose <br />(B) The Board of County Com issioners also recognize hat certain uses are appropriate <br />for development in Oran County but their location an ite development specifics <br />cannot be predetermi d or regulated through the use of a \ia ning district <br />designation and co entional standards <br />(C) Conditional Us and Conditional Use Districts are hereby and shall be <br />reviewed in cordance with the provisions of this Ordinanc <br />(D) Permitt Uses <br />(1) Any use listed as Permitted by Right or by Special t on the ble of Permitted Uses may be approved as a Con ditional a Conditio I Use District, unless expressly excluded in Section 5 1 4Ordinance (2) Permitted uses are subject to all general and specifs of approval for <br />that use, as established within this Section <br />(E) Exclusions <br />(1) Unless otherwise noted in Section 5 2, the following uses shall not be considered <br />or approved as a Conditional Use District within the Commercial - Industrial <br />Transition Activity Node or Economic Development Transition Activity Node land <br />use classifications, as designated by the adopted Comprehensive Plan <br />(a) Airports, General Aviation, Heliports, S T O L, <br />(b) Class II Kennels, <br />(c) Commercial Feeder Operation, <br />(d) Composting Operation with grinding, <br />(e) Crematoria, <br />(f) Extraction of Earth Products, <br />(g) Junkyards, <br />(h) Landfills (less than 2 acres), <br />(1) Landfills (2 acres or more), <br />q) Meat Processing Facility, Regional, <br />Orange County, North Carolina — Unified Development Ordinance Page 5 -2 <br />
