GRANT CONTRACT NO. 5833 <br /> 13. Supplantation of Expenditure of Public Funds: <br /> The Grantee assures that funds received pursuant to this Contract shall be used only to supplement, not to supplant, the <br /> total amount of federal, state and local public funds that the Grantee otherwise expends for Curbside Recycling Roll- <br /> Out Cart Grant Program services and related programs. Funds received under this Contract shall be used to provide <br /> additional public funding for such services;the funds shall not be used to reduce the Grantee's total expenditure of other <br /> public funds for such services. <br /> 14. Disbursements: As a condition of this Contract, Grantee acknowledges and agrees to make disbursements in <br /> accordance with the following requirements: <br /> a. Implement adequate internal controls over disbursements; <br /> b. Pre-audit all vouchers presented for payment to determine: <br /> • Validity and accuracy of payment <br /> • Payment due date <br /> • Adequacy of documentation supporting payment <br /> • Legality of disbursement <br /> c. Assure adequate control of signature stamps/plates; <br /> d. Assure adequate control of negotiable instruments;and <br /> e. Implement procedures to insure that account balance is solvent and reconcile the account monthly. <br /> 15. Outsourcing: The Grantee certifies that it has identified to the Agency all jobs related to the Contract that have been <br /> outsourced to other countries, if any. Grantee further agrees that it will not outsource any such jobs during the term of <br /> this Contract without providing notice to the Agency and obtaining written approval from the Agency Contract <br /> Administrator prior to outsourcing. <br /> 16. Assurances For Non-Federally Funded Contracts: The GRANTEE certifies that with regard to: <br /> 1. Debarment And Suspension-To the best of its knowledge and belief that it and its principals: <br /> (a) are not presently debarred, suspended, proposed for debarment, declared ineligible,or voluntarily excluded from <br /> covered transactions by any Federal,State,or local government agency; <br /> (b) have not within a 3-year period preceding this proposal been convicted of or had a civil judgment rendered <br /> against them for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or <br /> performing a public (Federal, State, or local) transaction or contract under a public transaction; violation of <br /> Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or <br /> destruction of records,making false statements,or receiving stolen property; <br /> (c) are not presently indicted for or otherwise criminally or civilly charged by a governmental entity(Federal, State, or <br /> local)with commission of any of the offenses enumerated in paragraph(1)(b)of this certification;and <br /> (d) have not within a 3-year period preceding this application/proposal had one or more public transactions(Federal, <br /> State,or local)terminated for cause or default. <br /> 2. Lobbying-To the best of his or her knowledge and belief,that: <br /> (a) No Federal, State or local government appropriated funds have been paid or will be paid, by or on behalf of the <br /> undersigned,to any person for influencing or attempting to influence an officer or employee of any Federal, State <br /> or local government agency; a member of Congress, North Carolina's General Assembly or local government <br /> body; an officer or employee of Congress, North Carolina's General Assembly or local government body, or an <br /> employee of a member of Congress, North Carolina's General Assembly or local government body, in connection <br /> Page 4 of 6 <br />
