listed shall be individually entitled to the rights and subject to the obligations set forth in this <br /> Agreement. <br /> (t) Patient Information shall mean medical or other health care information of <br /> or about an Individual which is Disclosed by Participants or Third Party Data Contributors <br /> through the HIE Network or which is maintained by NC HIE for indexing, record location or <br /> other purposes all in accordance with this Agreement, NC HIE Policies and Procedures and <br /> Applicable Law. <br /> (u) Permitted Purposes shall mean the following reasons for which Patient <br /> Information may be acquired,accessed,Disclosed or used through the HIE Network- <br /> i. Treatment of the Individual. Treatment shall mean the provision, <br /> coordination, or management of health care and related services by <br /> one or more Providers and that the use or Disclosure otherwise <br /> complies with the requirements of HIPAA as set forth in 45 CFR <br /> §164.506 (c) or successor provisions of HIPAA and is otherwise <br /> permitted by Applicable Law; <br /> ii. Payment activities, provided that the Participant has an established <br /> Treatment relationship with the Individual and that the use or <br /> Disclosure otherwise complies with the requirements of HIPAA as set <br /> forth in 45 CFR§164.506(c) or successor provisions of HIPAA and is <br /> otherwise permitted by Applicable Law; <br /> iii. Quality assessment and improvement activities, including care <br /> coordination, defined in the HIPAA Regulations as a subset of health <br /> care operations activities, provided that the Participant has an <br /> established Treatment relationship with the Individual and that the use <br /> or Disclosure otherwise complies with the requirements of HIPAA set <br /> forth in 45 CFR§164.506(c)or successor provisions of HIPAA and is <br /> otherwise permitted by Applicable Law; <br /> iv. Public Purpose; Public Purpose shall mean a Disclosure of Patient <br /> Information to public health officials or government agencies and <br /> others when required by Applicable Law or when permitted by <br /> Applicable Law and consistent with the mission of NC HIE <br /> V. Pursuant to an Authorization required by the BIPAA Regulations; <br /> vi. To demonstrate meaningful use of certified electronic record <br /> technology, provided that the purpose is not otherwise described in <br /> subdivisions (i.) through (v.) of this definition and the purpose is <br /> permitted by Applicable Law,including but not limited to the 1-11PAA <br /> Regulations. Meaningful use of certified electronic health record <br /> technology" shall have the meaning assigned to it in the regulations <br /> promulgated by the Department of Health and Human Services under <br /> the American Recovery and Reinvestment Act, Sections 4101 and <br /> 4102.; <br /> 4 <br />
