61 <br />2 <br />1 Chair Jacobs asked if it could be assumed that existing structures would be <br />2 treated differently than new structures. <br />3 Ashley Moncado said those would be grandfathered in. <br />4 Chair Jacobs said there had been discussion of defining non - profits as 501 -c -3. <br />5 He asked if this was included. <br />6 Ashley Moncado said this was revised and it is included on page 18. She said <br />7 this was not highlighted in green, but it has been included in the amendments. <br />8 Michael Harvey addressed Chair Jacobs earlier question. He said the non - <br />9 conforming section of the UDO says that any land use legally permitted, made non - <br />10 conforming by text amendment, can continue in its approved state until such time as its <br />11 use is expanded. He said if the home occupation is expanded above a certain <br />12 percentage, the occupant will then have to be in compliance with the code. <br />13 Commissioner Gordon referred to past discussions of the uses not permitted. <br />14 She noted that these uses are no longer prohibited. She asked for the original reason <br />15 for exclusion and the balancing provisions that then made them acceptable. <br />16 Ashley Moncado that these were always in the UDO as uses not permitted and <br />17 this was not a topic until the eleventh hour. She said there was then discussion to allow <br />18 these uses; and the planning board was willing to allow them, but there were limits put <br />19 in place to prevent them from being an intrusion to neighbors. <br />20 Commissioner Gordon asked how these changes are different for major home <br />21 occupations versus minor home occupations. <br />22 Ashley Moncado said this means less employees, less clients, smaller <br />23 accessory structures, lower traffic counts and less dwelling use for the minor home <br />24 occupations. She said the major home occupations would allow for more in each of <br />25 these areas. <br />26 Commissioner Gordon asked about the differences in outside storage <br />27 structures. <br />28 Ashley Moncado said this has remained the same, at 500 square feet for major <br />29 and minor. She said the traffic counts are not to exceed 20 for minor home occupations <br />30 and 50 for major home occupations. <br />31 Commissioner Gordon asked about delivery trucks. <br />32 Ashley Moncado said these are not counted, and there is no limit. <br />33 Commissioner Price asked for the rationale of 80 feet as a setback amount. <br />34 She asked if it was possible to go down to 60 feet. <br />35 Ashley Moncado said 80 feet was the minimum setback for those zoning <br />36 districts. She said the least amount would be 40 feet and the concern was doubling this <br />37 to keep that protective buffer. <br />38 Commissioner Price said she is concerned that this is making life more difficult <br />39 for those wanting to start a home business. <br />40 Ashley Moncado said 40 feet is the setback for the accessory structure, but the <br />41 80 feet is the setback to be exempt from screening requirements. <br />42 Commissioner Price asked if this requirement can be lessened. <br />43 Ashley Moncado said there is always the option for a variance if a hardship can <br />44 be identified. <br />
