61 <br />RECOMMENDATION: <br />Neither the Planning Board nor staff has received any information that would establish grounds for making a <br />negative finding on the general standards. These standards include maintaining or promoting the public health, <br />safety, and general welfare, maintaining or enhancing the value of contiguous property, and the use being in <br />compliance with the general plan for the physical development of the County. <br />The Planning Board has reviewed the application, the site plan, and all supporting documentation and has found <br />that the applicant complies with the specific standards and required regulations as outlined within the UDO. <br />Provided the Board of County Commissioners finds in the affirmative on the specific and general standards, the <br />Board could make a positive finding on this application. In the event that the BOCC makes the determination that <br />the permit can be issued, the Planning Board recommends the attachment of the following conditions to the <br />Special Use Permit: <br />(1) The applicant shall cause a formal and detailed landscape and tree preservation plan shall be submitted <br />and approved by the Orange County Planning Department within 180 days from the approval of the <br />Special Use Permit. <br />(2) A revised site plan shall be submitted denoting the required Pedestrian /Landscape Ratio for the project <br />as required under Section 3.3 of the UDO. This revised sheet shall be submitted within 180 days from <br />the approval of the Special Use Permit. <br />(3) That the applicant complete and submit a formal application to the Orange County Inspections <br />Department requesting authorization to commence construction of the proposed solar array. The <br />application, including all applicable fees, shall be submitted within 180 days from the approval of the <br />Special Use Permit. <br />(4) That the Orange County Fire Marshal's office shall review and approve the final site plan, as part of the <br />normal building permit review process, and that any and all modifications be made to address fire code <br />issues and access prior to the issuance of the permit authorizing the commencement of land disturbing <br />activities. <br />(5) The applicant shall provide a detailed, scaled, map to the Orange County Fire Marshal's office and the <br />Efland Volunteer Fire Department denoting the location of all storage areas for batteries, master cut -off <br />switches, and other similar devices to ensure the protection of emergency responders in the event of a <br />catastrophic incident on the property. This map shall be submitted prior to the issuance of a Certificate of <br />Occupancy by the County allowing for operation of the facility to commence. <br />(6) That prior to the commencement of land disturbing activity the applicant shall submit all necessary <br />stormwater, grading plans, and erosion control applications to the Orange County Erosion Control <br />Department for review and processing. These applications shall be submitted within 180 days from the <br />issuance of the SUP. <br />(7) That the applicant shall submit the approved site plan to NC DOT for review and comment. In the event it <br />is determined that the applicant is required to apply for, and receive a, driveway permit from NC DOT to <br />allow for the project to be developed, the applicant shall submit all necessary applications as required by <br />NC DOT within 180 days from the issuance of the SUP and provide planning staff with a copy of the <br />issued permit. <br />
