Harvey, Planner III, (919) 245-2597 <br /> Craig Benedict, Director, (919) 245-2575 <br /> PURPOSE: To adopt a revised Ordinance amending the Unified Development Ordinance <br /> (UDO) to correct a staff error. <br /> BACKGROUND: On January 23, 2014 the BOCC adopted Ordinance Number 2014-001, <br /> which involved revising existing regulations to address recent changes in State law related to <br /> the operation of the Board of Adjustment, specifically: <br /> • Change the votes necessary for the Board to approve a Special Use Permit application <br /> from 4/5th of members to a simple majority, <br /> • Clarify procedure(s) for requesting and issuing of subpoenas, <br /> • Clarify appeals timeframe for Board of Adjustment decisions to be submitted to Superior <br /> Court, and <br /> • Clarify notification requirements with respect to who is notified of a Board decision. <br /> While reviewing the adopted Ordinance, staff discovered spelling errors and other typos within <br /> various sections, namely: <br /> 1. Section 2.10.3 (a): Staff misspelled `peculiar'. The mistake has been corrected. <br /> 2. Section 2.10.3 (b): Staff repeated the phrase: `hardships resulting from personal <br /> circumstances' unnecessarily. The error has been corrected. <br /> 3. Section 2.11.3 (B): Staff misspelled `affidavit'. The mistake has been corrected. <br /> It should be noted the Planning Board had identified these errors at its December 2013 regular <br /> meeting where the Board voted to recommend approval of the amendment package with these <br /> errors being corrected. Unfortunately staff did not provide the BOCC with a revised document <br /> consistent with this recommendation. <br /> Staff is seeking to correct these errors by having the Board adopt a corrected Ordinance. <br />
