(B) In making its decision, the Board of Commissioners shall consider all relevant evidence <br />presented at the public hearing and any submitted written evidence that was considered <br />by the Planning Board in making its recommendation. <br />2.8.'hQ Text Revisions Pertaininq to Soil Erosion and Sedimentation Control Provisio <br />The Erosion Control Officer shall review all of the North Carolina Sedim ation Control <br />Commission's revisions to the State's Model Soil Erosions and Sedi ntation Control <br />finance and, within 90 days of receipt of the recommended re ions, submit draft <br />ame ents to the North Carolina Sedimentation Control Cc fission for its <br />consideNion and comments. <br />(B) Within 150 da after receipt of the North Carolina S imentation Control Commission's <br />comments, Oran County shall formally cons ide roposed amendments and, to the <br />extent deemed neces ry by the Board of Co y Commissioners, incorporate the <br />amendments into this Or ance. <br />(C) Text amendments to this OrdiftQceWsoil erosion and sedimentation control provisions <br />shall comply with the requiremenIV4Q effect for any other text amendment. <br />2.8.11 Text Revisions Pertaining to St�water P <br />(A) The Erosion Control ficer shall review all of th State Environmental Management <br />Commission's re ions to the State's Model Stormv ter Ordinance and, within 90 days <br />of receipt of t recommended revisions, submit draft a endments to the State <br />Environm al Management Commission for its consideraft&Q and comments. <br />(B) With 150 days after receipt of the State Environmental Manag ent Commission's <br />c ments, Orange County shall formally consider proposed amen nts and, to the <br />extent deemed necessary by the Board of County Commissioners, inco rate the <br />amendments into this Ordinance. <br />Text amendments to this Ordinance for stormwater provisions shall comply with <br />requirements in effect for any other text amendment. <br />2.8.12 Setting Public Hearing Dates <br />(A) The Board of County Commissioners shall adopt a meeting schedule that designates a <br />minimum of eight dates annually, spread throughout the year, for potential public <br />hearings for UDO /Comprehensive Plan- related items. <br />(B) The Planning Director shall establish and publish application due dates for each potential <br />public hearing in a timely manner after the Board of County Commissioners adopts its <br />meeting schedule. <br />2.9.1 Conditionalttse`District (CUD) <br />(A) Generally <br />(1) Any use permitte der the CUD proc shall conform to all applicable <br />development regulatio r the sponding general use zoning district as well <br />as any specific developme3Ps<dards outlined within this Ordinance. <br />(2) The Board of Cou ommissioners, eviewing a CUD application, may <br />impose suc asonable conditions upon appfQval of a CUD request as will <br />affor ection of the public health, safety, and g ral welfare, ensure that <br />stantial justice is done, and ensure equitable treatme <br />Only those conditions mutually agreed to by the applicant and the and of <br />County Commissioners may be imposed on a CUD application. <br />319 <br />Return to Agenda <br />
