He said it would be <br /> 2 entertained for future cases. <br /> 3 <br /> 4 A motion was made by Commissioner Pelissier, seconded by Commissioner McKee to <br /> 5 adopt a resolution to deny a refund request from Mr. Robert H. Pope covering tax years 2009, <br /> 6 2010, 2011 and 2012, in accordance with North Carolina General Statute 105-381. <br /> 7 <br /> 8 Chair Jacobs said the Board sympathizes with the individuals who are victimized by the <br /> 9 way this law is written and interpreted. <br /> 10 Commissioner Dorosin said you do what you think is right and let the law catch up. <br /> 11 <br /> 12 VOTE: Ayes, 4; Nays, 3 (Commissioner Dorosin, Commissioner Rich and Commissioner Price) <br /> 13 <br /> 14 CONSENT AGENDA <br /> 15 a. Minutes <br /> 16 The Board approved the minutes from September 9 and 17, 2013 as submitted by the Clerk to <br /> 17 the Board. <br /> 18 b. Motor Vehicle Property Tax Releases/Refunds <br /> 19 The Board adopted a resolution, which is incorporated by reference, to release motor vehicle <br /> 20 property tax values for eighty-eight (88) taxpayers with a total of ninety-six (96) bills that will <br /> 21 result in a reduction of revenue, accordance with the NCGS. <br /> 22 c. Property Tax Releases/Refunds <br /> 23 The Board adopted a resolution, which is incorporated by reference, to release property tax <br /> 24 values for two (2) taxpayers with a total of two (2) bills that will result in a reduction of revenue, <br /> 25 in accordance with North Carolina General Statute 105-381. <br /> 26 d. Applications for Property Tax Exemption/Exclusion <br /> 27 The Board approved five (5) untimely applications for exemption/exclusion from ad valorem <br /> 28 taxation for eight (8) bills for the 2013 tax year. <br /> 29 f. Legal Advertisement for Quarterly Public Hearing — November 25, 2013 <br /> 30 The Board approved the legal advertisement for items to be presented at the joint Board of <br /> 31 County Commissioners/Planning Board Quarterly Public Hearing scheduled for November 25, <br /> 32 2013. <br /> 33 g. Request for Road Addition to the State Maintained Secondary Road System <br /> 34 The Board approved a recommendation to the North Carolina Department of Transportation <br /> 35 (NCDOT), and in turn the North Carolina Board of Transportation (BOT), concerning a petition <br /> 36 to add a total of eleven (11) subdivision roads in Churton Grove Phase 4 Subdivision to the <br /> 37 State Maintained Secondary Road System. <br /> 38 h. Bid Award — McGowan Creek Sewer Interceptor Project and Approve Budget <br /> 39 Amendment #2-D <br /> 40 The Board: <br /> 41 • Awarded the bid and approved a construction contract (pending State approval) to Park <br /> 42 Construction of North Carolina, Inc. of Morrisville, NC in the amount of$597,813.13 for <br /> 43 the construction of the McGowan Creek Sewer Interceptor; <br /> 44 • Approved Budget Amendment#2-D for $107,814 (bids received were in excess of the <br /> 45 originally budgeted project construction cost) consisting of: <br /> 46 o Authorizing staff to request an additional $50,000 in SRF loan funding from the <br /> 47 State; <br /> 48 o Approving funding of$57,814 from Article 46 Sales Tax proceeds; <br /> 49 Approved and authorized the Chair to sign the Resolution of Tentative Award for this <br /> 50 project, as required by the State Revolving Fund Loan; <br />
