A Board member asked why existing language, as contained in <br /> Section 2.10.3 establishing when a variance is authorized to be <br /> issued, was being modified. <br /> Concern was expressed the new language appeared to make it easier <br /> to obtain a variance as it was no longer required for an applicant to <br /> demonstrate that: <br /> • In absence of the variance, no reasonable use can be made of <br /> the property, or <br /> • That knowledge of an issue, prior to the purchase of property, <br /> no longer constituted a self-created hardship. <br /> STAFF RESPONSE The language was being revised to comply with <br /> revisions to State law as embodied in Session Law 2013-126. While <br /> staff shares the concern we are obligated to ensure our standards <br /> mirror State regulations. <br /> 2. A Board member asked staff how the change in voting requirements <br /> for Special Use Permits, specifically allowing for a simple majority <br /> versus a 4/5 1h (i.e. 4 out of 5 members) majority of the Board of <br /> Adjustment to approve a permit, would impact the County. <br /> 3 <br />
