STATE OF NORTH CAROLINA NONURBANIZED AREA <br /> COUNTY OF WAKE PUBLIC TRANSPORTATION <br /> GRANT AGREEMENT FOR <br /> PUBLIC BODY <br /> NORTH CAROLINA ELDERLY INDIVIDUAL AND INDIVIDUALS <br /> WITH DISABILITIES <br /> DEPARTMENT OF TRANSPORTATION PROGRAM—SECTION 5310 <br /> and CFDA NUMBER: 20.513 <br /> ORANGE COUNTY PROJECT NUMBER: 14-ED-056 <br /> AGREEMENT NUMBER: <br /> THIS AGREEMENT made this theZ,5-t day ofA , 201,3, (hereinafter referred to as <br /> AGREEMENT) by and between the NORTH CAROLINA DEPARTMENT OF <br /> TRANSPORTATION (hereinafter referred to as "Department", an agency of the State of North <br /> Carolina) and ORANGE COUNTY, (acting in its capacity as the designated Section 5310 <br /> recipient hereinafter referred to as the "Contractor"). <br /> WHEREAS, Chapter 53 of 49 U.S.C. app 5310 et seq. provides federal formula public <br /> transportation funds for administrative, operating, and capital purposes to assist private or <br /> designated public nonprofit agencies in meeting the transportation needs of older adults and <br /> people with disabilities in rural and small urban areas. <br /> WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes (N.C.G.S.) <br /> designated the Department of Transportation as the agency of the State of North Carolina <br /> responsible for administering all Federal and/or State programs relating to public transportation, <br /> and granted the Department authority to do all things required under applicable Federal and/or <br /> State legislation to properly administer the public transportation within the State of North <br /> Carolina; and <br /> WHEREAS, the Governor of North Carolina, in accordance with Section 5310 of the Safe, <br /> Accountable, Flexible, and Efficient Transportation Equity Act - A Legacy for Users (SAFETEA- <br /> LU), Public Law 109-59, August 10, 2005, and the Transportation Equity Act for the 21 St Century <br /> (TEA-21), Public Law 105-178, June 1998, as amended, has designated the North Carolina <br /> Department of Transportation as the agency to receive and administer Federal funds under this <br /> program; and <br /> WHEREAS, the Contractor has been designated as the recipient of 49 U.S.C. 5310 <br /> funds, and, <br /> WHEREAS. in order to assist in providing transportation services, the Department, under <br /> the terms of this Agreement shall make grants for operating and capital assistance to the <br /> Contractor; and <br /> WHEREAS, the Department and the Contractor desire to secure and utilize Section 5310 <br /> grant funds and State funds for the above referenced purposes. <br /> NOW, THEREFORE, in consideration of the mutual covenants herein set forth, the <br /> Department and the Contractor agree as follows: <br /> Section 1. Purpose of Agreement. The purpose of this Agreement is to provide the <br /> terms, conditions, guidance and mutual undertakings of each party for the implementation of the <br /> 5310 program. This agreement outlines the project and services and the manner in which the <br /> Project will be undertaken and completed to meet the transportation needs of elderly persons <br /> and persons with disabilities. This agreement is properly prepared, endorsed, approved, and <br /> transmitted by the Contractor to the Department for full execution. <br />
