HOMESTEAD HIGHLANDS - CONTINUATION <br /> Planner Susan Smith presented for receipt of input from the <br /> Towns on urban services and annexation policies within the <br /> Joint Planning area the request from Piedmont Atlantic Inc. <br /> for a general rezoning of property located north of Homestead <br /> Road and 400 feet west of the intersection of Homestead Road <br /> and Rogers Road in Chapel Hill Township. <br /> Planning Director Marvin Collins identified and reported on <br /> the two issues that were discussed at the February 24 meeting" <br /> (1) How Chapel Hill and Carrboro would deal with the <br /> annexation implications associated with the tract and <br /> (2) how service agencies such as volunteer fire departments <br /> would be affected by annexation of development. <br /> With regard to annexation both jurisdictions have indicated it <br /> would be highly desirable to adopt a mutual growth boundary <br /> beyond which neither jurisdiction would annex. Both have <br /> indicated, however, that adoption of such a boundary would <br /> require staff analysis first, then governing board review and <br /> action. <br /> With regard to service implications, the general statutes <br /> provide a basis for mitigating the net loss to a fire district <br /> if annexation is by municipal action. If annexation occurs as <br /> a result of satellite annexation by petition of the owner, the <br /> only easing of the tax situation could be accomplished through <br /> prorating of taxes or through the municipality setting the <br /> effective date of annexation such that taxing by a fire <br /> district and a municipality would not overlap. <br /> In conclusion, Marvin Collins stated that at this time nothing <br /> can be done to address these two problems. This is a rezoning <br /> request and the annexation issue needs to be resolved by <br /> Chapel Hill and Carrboro to avoid questions in the future. <br /> Chair Willhoit indicated the two issues need to be resolved <br /> prior to the time development requests are received. <br /> WITH NO FURTHER COMMENTS THE HEARING WAS DECLARED CLOSED. <br /> Motion was made by Commissioner Lloyd, seconded by <br /> Commissioner Carey to refer this rezoning request for <br /> Homestead Highlands to the Planning Board for further <br /> consideration and recommendation. <br /> VOTE: UNANIMOUS. <br /> E. ITEMS FOR DECISION <br /> 1. PROPOSED ZONING ORDINANCE TEXT AMENDMENTS (A copy of the <br /> approved amendments are in the official Ordinance Book in the <br /> office of the Clerk to the Board) . <br /> Planner Susan Smith presented for consideration of approval <br /> the proposed text amendments to the Zoning Ordinance as <br /> submitted to public hearing on November 25, 1985 and February <br />
