3 <br /> PROPOSED ORDINANCE/PLAN AMENDMENT <br /> ORDINANCE/PLAN: EDUCATIONAL FACILITIES IMPACT FEE ORDINANCE <br /> REFERENCE: Section 3 School Impact Fees Imposed on New Residential Structures <br /> ORIGIN OF AMENDMENT: __X__�Staff Planning Board X BOCC Citizen <br /> Other. <br /> STAFF PRIORITY RECOMMENDATION:_2�_High Middle Low <br /> PUBLIC HEARING DATE: May 28, 1996 <br /> PURPOSE OF AMENDMENT: To amend the Educational Facilities Impact Fee Ordinance to consider <br /> increasing the current schedule of impact fees. <br /> IMPACTS/ISSUES: The proposed amendment is for the purpose of considering an increase in the current <br /> schedule of impact fees. Specifically, Section 3, School Impact Fees Imposed on New Residential <br /> Structures, is proposed for amendment to increase the impact fee in the Chapel Hill-Carrboro School <br /> District from $1,500 to no more than $3,000. The change is based on a recalculation of the fees in the <br /> Educational Facilities Impact Fee Technical Report and reflects new demographic data concerning students <br /> per household as well as the recommendations of the School Facilities Construction Standards Work <br /> Group. <br /> No increase in the impact fee in the Orange County School District is proposed. <br /> EXISTING/PROPOSED ORDINANCE/PLAN PROVISIONS: <br /> Applicable sections of the ordinance are shown below. Text to be deleted is shown in s4gwthfeugh <br /> highlighting,while new wording is shown in boldface italics type. <br /> SECTION 3-SCHOOL IMPACT FEES IMPOSED ON <br /> NEW RESIDENTL4L DWELLING UNITS <br /> In addition to all other charges prescribed by ordinance or resolution now or hereafter in effect, <br /> there shall be public school impact fees charged to new residential dwelling units located within Orange <br /> County, and within the municipalities and their extraterritorial planning jurisdictions located within <br /> Orange County. No person may occupy any new residential dwelling unit until all applicable public <br /> school impact fees contained in the following schedule have been paid in full. No certificate of occupancy <br /> or other type of occupancy permit shall be issued for any new residential dwelling unit until the public <br /> school impact fees hereby required have been paid in full. Payment of such fees shall not relieve the <br /> feepayer from the obligation to comply with applicable land development regulations of Orange County or <br /> the municipalities located within Orange County. <br />
