1.6.1. General Administration of Construction Contract - Consult with and advise the <br /> OWNER and act as his representative as provided in the General Conditions of the Contract Documents; <br /> the extent and limitations of the duties, responsibilities and authority of the ENGINEER as assigned in <br /> said General Conditions shall not be modified without the ENGINEER'S written consent; all of the <br /> ENGINEER'S instructions to the Contractor(s) will be issued through the ENGINEER who will have <br /> authority to act on behalf of the OWNER to the extent provided in said General Conditions except as <br /> otherwise provided in writing. Make arrangements for and conduct a preconstruction meeting. <br /> 1.6.2. Establish field control and reference points to enable the Contractor(s) to proceed with <br /> the layout of the work. <br /> 1.6.3. Visits to Site and Observation of Construction. In connection with observations of <br /> the work of Contractor(s)while it is in progress: <br /> 1.6.3a. The ENGINEER shall make visits to the site at intervals appropriate to the various <br /> stages of construction as the ENGINEER deems necessary in order to observe as an experienced and <br /> qualified design professional the progress and quality of the various aspects of the Contractor(s)' work. <br /> Based on information obtained during such visits and on such observations, the ENGINEER shall <br /> determine in general if such work is proceeding in accordance with the Contract Documents and the <br /> ENGINEER shall keep the OWNER informed on the progress of the work. <br /> 1.6.3b. The ENGINEER shall not be required to make exhaustive or continuous on-site <br /> inspections to check the quality or quantity of such work. The purpose of the ENGINEER's visits to the <br /> site will be to enable the ENGINEER to better carry out the Construction Phase, and, in addition, by <br /> exercise of the ENGINEER's efforts as an experienced and qualified design professional, to provide for <br /> the OWNER a greater degree of confidence that the completed work of the Contractor(s) will conform <br /> generally to the Contract Documents and that the integrity of the design concept as reflected in the <br /> Contract Documents has been implemented and preserved by the Contractor(s). On the other hand, the <br /> ENGINEER shall not, during such visits or as a result of such observations of the Contractor(s)' work in <br /> progress, supervise, direct or have control over the Contractor(s)' work nor shall the ENGINEER have <br /> authority over or responsibility for the means, methods, techniques, sequences or procedures of <br /> construction selected by the Contractor(s), for safety precautions and programs incident to the work of <br /> the Contractor(s) or for any failure of the Contractor(s) to comply with laws, rules, regulations, <br /> ordinances, codes or orders applicable to the Contractor(s) furnishing mad performing their work. <br /> Accordingly, the ENGINEER can neither guarantee the performance of the Construction contracts by <br /> the Contractor(s) nor assume responsibility for the Contractor(s)' failure to furnish and perform their <br /> work in accordance with the Contract Documents. If in the opinion of the ENGINEER the Contractor <br /> fails to carry out their obligations as described in the Contract Documents the ENGINEER will give <br /> notice of same to the OWNER and Contractor. <br /> 1.6.4 Defective Work. During such visits and on the basis of such observations, the <br /> ENGINEER may disapprove of or reject the Contractor(s)' work while it is in progress if the <br /> ENGINEER believes that such work will not produce a completed Project that conforms generally to the <br /> Contract Documents or that it will prejudice the integrity of the design concept of the Project as reflected <br /> in the Contract Documents. <br /> 1.6.5. Interpretations and Clarifications. The ENGINEER shall issue necessary <br /> interpretations and clarifications of the Contract Documents and in connection therewith prepare work <br /> directive changes and change orders as required,which will be subject to approval by the OWNER. <br /> 1.6.6. Shop Drawings. The ENGINEER shall review and take appropriate action on Shop <br /> Drawings (as that term is defined in the aforesaid General Conditions), samples and other data which the <br /> Contractor(s)are required to submit. Such review shall be only for general conformance with the design <br /> concept of the Project and general compliance with the information given in the Contract Documents. It <br /> shall not include review of quantities, dimensions, weights or gauges, fabrication processes, construction <br /> methods, coordination with the work of other trades or construction safety precautions, all of which are <br /> the sole responsibility of the Contractor(s).
