SENT BY: 11-25-36 3:54 ; Northen Blue 91964430024 3114 <br /> 8 <br /> unconditional gift, hereby gives, grants, bargains, sells and conveys unto the Grantor a <br /> Conservation Easement in perpetuity over the Protected Property of the nature and character as <br /> follows: <br /> 1. Purpose. The purpose of this Conservation Easement is to ensure that the Protected <br /> Property will be retained forever predominantly in its natural state; to protect any regionally rare <br /> plants, animals or plant communities as well as state-or federal-monitored plants or animals on <br /> the Protected Property; to protect the water quality of Stoney Creels; and to prevent any use of <br /> the Protected Property that will significantly impair or interfere with the conservation values or <br /> interests of the Protected Property described above. The Grantor intends that this Conservation <br /> Easement will restrict the use of the Protected Property to only such activities as are consistent <br /> with the purpose of this Conservation Easement. <br /> 2. ProWded Uses, Any activity on or use of the Protected Property inconsistent with the <br /> purpose of this Conservation Easement is prohibited. without limiting the generality of the <br /> foregoing, the following activities' and uses are expressly prohibited except as provided in <br /> paragraph 3 below: <br /> 2.1 The legal or de facto subdivision of the Protected Property for any purpose; <br /> 2.2 Any eommesrcW or industrial use of or activity on the Protected Property; <br /> 2.3 The plaoemnent or construction of any buildings, structures, or otber improvements <br /> of any kind(including, without limitation, fences, roe&and parldnng lob); <br /> 2.4 Any alteration of the surface of the land, including, without limitation, the <br /> excavation or removal of soil, sand, gravel, rock, peat. or sod,except as required in the course <br /> of any activity permitted herein; <br /> 0 time J 2 <br />
