3 <br /> NORTH CAROLINA <br /> ORANGE COUNTY <br /> Amendment to <br /> Orange County HOME Consortium <br /> HOME Investment Partnership Program Consortium Agreement <br /> THIS AGREEMENT made and entered into by and among the County of Orange <br /> (hereinafter "County"), the Town of Carrboro, the Town of Chapel Hill, and the <br /> Town of Hillsborough (hereinafter "Towns"), each being a general local <br /> governmental unit of the State of North Carolina, and is made pursuant to North <br /> Carolina Statutes, Article 20 of Chapter 160A. <br /> WHEREAS, County and Towns entered into the Orange County HOME <br /> Consortium HOME Investment Partnership Program Consortium Agreement <br /> (hereinafter"the Agreement") on or about June 25, 1996; and <br /> WHEREAS, County and Towns agree that it is desirable and in the interests of <br /> their citizens to secure approval by the federal government be considered as a <br /> consortium under the federal HOME Program operated by the U.S. Department <br /> of Housing and Urban Development as authorized under the HOME Investment <br /> Partnership Act, Title II of the Cranston-Gonzalez National Affordable Housing <br /> Act of 1990, as amended; and <br /> WHEREAS, the proper administration of the Agreement requires that there be <br /> amendments to the Agreement; <br /> NOW, THEREFORE, the County and Towns agree that the Agreement is <br /> amended as follows: <br /> Section III, Agreement <br /> Rewrite Paragraph A to read: <br /> A. The term of this Agreement begins with the effective date of july 1, <br /> July 1, 1997 and ends June 30, 2000. Subject to the requirements of <br /> Pa graph D of this Section, the County and Towns agree that the terms <br /> of this Agreement cover the period necessary to carry out all activities that <br /> will be funded from funds awarded during three federal fiscal years <br /> (Fiscal Years 1997, 1998, and 1999) and that all members of OHC will <br /> remain in OHC for the entire period. The Agreement remains in effect <br /> until the HOME funds from each of the federal fiscal years of the <br /> qualification period are closed out pursuant to 24 CFR 92.507. <br />
