79 <br /> and Duke Forest (the "Preserve and Forest"). This Buffer Zone, more particularly described on <br /> Plat recorded in Map Book , Page , Orange County Registry, is intended to remain in <br /> its natural state. Within the Buffer Zone, no private paths shall be permitted for access to the <br /> Preserve and Forest. Additionally, removing, destroying or cutting trees and vegetation within <br /> the Buffer Zone is strictly prohibited except for: <br /> (1) selective removal of trees or vegetation for the prevention or treatment of disease; <br /> (2) removal of dead or fallen trees and trees posing a hazard; <br /> (3) removal of invasive, non-native or noxious plants that threaten indigenous plant <br /> species; and <br /> (4) selective and minimal clearing necessary for the creation of reserved septic fields <br /> for the remediation of failed septic fields. <br /> In addition to the foregoing restrictions, prior to the commencement of construction of <br /> any dwelling or other improvements upon any single Lot subdivided out of the Property which <br /> Lot borders the Preserve and Forest, the Lot Owner shall install orange plastic tree protection <br /> fencing along the boundary line separating the Buffer Zone from the buildable area of the Lot. <br /> The protective fencing shall not be removed from the Lot until completion of construction and <br /> installation of all improvements to the Lot. <br /> ARTICLE IV. <br /> MEMBERSHIP AND VOTING RIGHTS <br /> Section 1. Every Owner of a lot which is subject to assessment shall be a member of the <br /> Association. Membership shall be appurtenant to and may not be separated from ownership of <br /> any lot which is subject to assessment. <br /> Section 2. The Association shall have two classes of voting membership: <br /> a. CLASS "A". Class A members shall be all Owners with the exception of the <br /> Declarant and shall be entitled to one vote for each Owner. When more than one <br /> person holds an interest in any lot, all such persons shall be members. The vote for <br /> such lot shall be exercised as they among themselves determine, but in no event shall <br /> more than one(1) vote be cast with respect to any lot. <br /> b. CLASS "B". The Class B member shall be the Declarant or Developer and Declarant <br /> or Developer shall be entitled to six (6) votes for each lot owned. The Class B <br /> membership shall cease and be converted to Class A membership on the happening of <br /> either of the following events, whichever occurs earlier: <br /> (1) When the total votes outstanding in Class A membership equals the total votes <br /> outstanding in the Class B membership, but provided, that the Class B <br /> 737112.ARC.25437.T26258 5 <br />
