5 <br /> • Roadside Buffer— 75 foot roadside buffer along Whitfield Road: 2.61 acres <br /> • Woodlands — preservation of existing forested area as an open space buffer: <br /> 2.22 acres west of Dumfries Lane and .24 acres east of Lockwood <br /> • Pedestrian Open Space Access (POSA): .33 acres <br /> TOTAL: 12.16 acres (33.31%) of the subject parcel <br /> Open space areas are composed of existing, mature, vegetation and trees with an approximate height <br /> of between 50 to 70 feet. <br /> The Preliminary Plat denotes a pedestrian open space access (POSA) affording potential future <br /> connectivity to an adjacent property, owned by TLC, as well as a pedestrian footbridge over the <br /> existing stream. The project calls for an internal trail system connecting Dumfries Lane to Lockwood <br /> Court passing between Lots 9 and 10 and Lots 5 and 6 respectively. This internal trail system has not <br /> been designed as a POSA as the applicant is concerned over third party access and wishes to limit <br /> use of the aforementioned internal trail to residents of the project. <br /> STAFF COMMENT: Staff has determined the proposed open space meets the <br /> requirements of the UDO. <br /> Land Use Buffer: As previously indicated, there will be a 75-foot buffer along Whitfield Road <br /> comprised of existing, dense, vegetation, and trees with an approximate height of between 50 to 70 <br /> feet. The applicant is also proposing a 50-foot tree protection area along the perimeter of the project <br /> abutting TLC and Duke Forest property. <br /> STAFF COMMENT: Staff has determined the proposed land use buffer meets the <br /> requirements of the UDO. <br /> Recreation: The applicant is proposing to provide a payment-in-lieu of parkland dedication in the <br /> amount of$5,005 ($455 times 11 lots) as provided within the UDO. <br /> Additional Comments: Attachment 3 contains additional comments for this project, including: <br /> • An e-mail from David Sykes, Orange County Emergency Management, indicating there is <br /> an existing pond in the area to address fire suppression issues. <br /> • An e-mail from Jeff Scouten, Orange County Solid Waste, approving road layout and <br /> construction. <br /> It should be noted that staff has not received any comments/concerns from either Triangle Land <br /> Conservancy (TLC) or Duke Forest related to this proposal. Both were notified of the <br /> neighborhood information meeting and regarding their possible interest in assuming <br /> management of proposed open space areas. Given the applicant's proposed land use buffers <br /> and tree protection areas, it would appear any concerns over ancillary impacts have been <br /> addressed. <br /> JPA Review: In accordance with the Joint Planning Area (JPA) Agreement, this project was sent <br /> to the Town of Chapel Hill for review and comment on December 17, 2012. To date, staff has <br /> not received any comments. <br /> Planning Board Recommendation: At its March 6, 2013 regular meeting, the Planning Board <br /> voted 9 to 1 to recommend approval of the Annandale at Creek Wood Preliminary Plat <br />
