Memorandum 4 <br /> To: Landfill Owners Group <br /> From: Gayle Wilson, Solid Waste Director <br /> Subject : Offer of property for sale - Johnson tract <br /> Date: December 13 , 1995 <br /> The Landfill Owners Group has been contacted regarding their <br /> interest in purchasing a tract of property adjacent to the current <br /> facility. This memorandum requests guidance on responding to this <br /> inquiry and suggests a possible course of action. <br /> Background <br /> In the summer of 1984, the staff was contacted by Mr. Simon R. <br /> Johnson, owner of a 13 . 8 acre tract of land adjoining the North <br /> Eubanks facility regarding his interest in selling this property to <br /> the landfill . We told Mr. Johnson that the local governments were <br /> involved in a landfill site search process and that one of the <br /> candidate sites, OC-17, included his property. We indicated that <br /> the; Owners Group would likely be unwilling to consider purchasing <br /> his property due to the ongoing site search, but might consider <br /> purchasing the land at some point in the future, -particularly if <br /> site' OC-17 was selected as the next landfill site. <br /> This past summer, Mr. Johnson passed away and his wife and her <br /> attorney are again interested in making this property available to <br /> the landfill . <br /> Discussion <br /> The Landfill Owners Group has been contacted by Mrs . Shirley B . <br /> Johnson, Administratrix of 'the-Estates of Lisbon R. Johnson and his <br /> deceased son Simon R. Johnson, with regard to a 13 . 8 acre tract of <br /> land located on Eubanks Road (Tax Map Reference : 7 . 18 . .27D) . The <br /> property is located directly adjacent to and west of the existing <br /> North Eubanks Facility (Attachment A) . The property is zoned Rural <br /> Buffer and is vacant land. The site has recently been timbered and <br /> is largely denuded of all mature natural vegetation. <br /> The staff wishes to receive Owners Group authorization to initiate <br /> preliminary negotiations with Mrs . Johnson regarding the purchase <br /> of this property. We wish to pursue acquisition of this property <br /> for two primary reasons . First, we believe it would be <br /> advantageous for the landfill to acquire the property in order to <br /> increase its present 100• foot buffer and provide additional area to <br /> expand mulching and recycling operations . We are presently <br /> constrained by a lack of additional useable space at the Eubanks <br /> Road facility. Secondly, the property would be necessary to <br /> acquire if the governing boards proceed with the selection of site <br /> OC-17 . <br /> 1 Recommendation: That the LOG authorize the Chapel Hill Town <br /> Manager to enter into negotiations regarding the possible purchase <br /> of the Johnson Tract, including obtaining a signed Offer to Sell <br /> should negotiations be successful . The staff would then return to <br /> the LOG with further recommendations . <br />
