The use will be in compliance with the plan <br /> for physical development of the County as <br /> embodied in these regulations and in the <br /> Comprehensive Plan. <br /> November 27, 1995 Public Hearing Comments <br /> Several citizens spoke in support of the Special <br /> Use Permit. <br /> One neighboring property owner felt that the <br /> business is not suitable for the area. He did <br /> request that the Commissioners approve the Special <br /> Use Permit, provided that the applicant be <br /> required to participate equally in paving Baldwin <br /> Road, and that the facility be inspected for <br /> building code compliance. (See also comments under <br /> "Access" heading. ) <br /> Minutes of the hearing are attached. <br /> Planning Board Action <br /> On December 18, 1995, the Planning Board <br /> recommended approval of the Class A Special Use <br /> Permit by a 7-3 vote, with the condition that the <br /> structure be approved for commercial use by the <br /> Orange County Inspections Division. (See attached <br /> Minutes. ) Compliance with Federal and State <br /> Building Codes is a requirement of Special Use <br /> Permit approval. The applicant has retained a <br /> registered engineer to determine the integrity of <br /> the structure. The applicant intends to fulfill <br /> the recommendations of the consulting engineer. <br /> The Orange County Inspections Division will <br /> inspect the premises and notify the applicant of <br /> any required improvements to the structure and for <br /> physically handicapped accessibility. These <br /> improvements must be completed before the Special <br /> Use Permit may be recorded. <br /> RECOIrIIrIENDATION: The Administration recommends approval of the <br /> proposed Class A Special Use Permit Application. <br />
