Compliance with <br /> Federal and State Building codes is a requirement <br /> of Special Use Permit approval. The applicant is <br /> in the process of obtaining certification from a <br /> registered engineer regarding the integrity of <br /> the structure. After review of this information <br /> by the Orange County Inspections Division, the <br /> applicant will be notified of any required <br /> improvements to the structural and physically <br /> handicapped accessibility requirements. These <br /> improvements must be completed before the Special <br /> Use Permit may be recorded. <br /> Willis distributed a letter from Thomas R. <br /> Magnuson of The Piedmont River Fords Project <br /> citing the historic nature of Baldwin Road and <br /> requesting that it not be paved. (Copy an <br /> attachment to these minutes on page . j <br /> Rosemond asked if the business would be allowed <br /> to expand in the future if the Special Use Permit <br /> is approved. Hinkley responded that they would <br /> be held to the present plan. There is a six year <br /> limitation on the Special Use Permit; it must be <br /> renewed every six years. If they should wish to <br /> expand, they must submit an application and <br /> plan and go through the permitting process again. <br /> Katz asked for clarification regarding compliance <br /> with Federal building codes. Hinkley said that <br /> standards of Federal Physically Impaired Access <br /> Acts enforced by the State must be met. Katz also <br /> asked if they must comply with the same codes as <br /> for new commercial buildings. Hinkley noted that <br /> they must comply with those codes regarding <br /> safety and fire. Willis noted that the applicant <br /> and Planning Staff have been working with a <br /> private structural engineer and Inspections Staff <br /> to determine what improvements must be made to <br /> comply with the building code relating to fire, <br /> safety, and handicap access. <br /> Reid asked if the applicant would be subject to <br /> any changes that might occur in building codes <br /> if a request for renewal is presented in six <br /> years. Hinkley responded that the applicant would <br /> have to go through the process as if it were a <br /> new application for a Special Use Permit. <br /> Brown asked about the six year time limit and <br /> whether the intent of that time limit was known. <br /> Willis responded that she did not know the <br />
